                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the temporary furlough policy of the Texas Department
    1-2  of Criminal Justice.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 501.006, Government Code, is amended by
    1-5  adding Subsection (j) to read as follows:
    1-6        (j)  The institutional division may not grant a furlough
    1-7  under Subsection (c) to an inmate serving a sentence for or
    1-8  previously convicted of an offense:
    1-9              (1)  listed in Section 3g(a)(1), Article 42.12, Code of
   1-10  Criminal Procedure;
   1-11              (2)  for which the court made an affirmative finding
   1-12  under Section 3g(a)(2) of that article; or
   1-13              (3)  listed in one of the following sections of the
   1-14  Penal Code:
   1-15                    (A)  Section 22.011 (sexual assault);
   1-16                    (B)  Section 25.02 (prohibited sexual conduct);
   1-17                    (C)  Section 43.25 (sexual performance by a
   1-18  child); or
   1-19                    (D)  Section 43.26 (possession or promotion of
   1-20  child pornography).
   1-21        SECTION 2.  This Act takes effect September 1, 1995.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
