S.B. No. 72
                                        AN ACT
    1-1  relating to the release of information kept in vessel and outboard
    1-2  motor ownership records.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter B, Chapter 31, Parks and Wildlife
    1-5  Code, is amended by adding Section 31.0391 to read as follows:
    1-6        Sec. 31.0391.  RELEASE OF INFORMATION.  (a)  The department
    1-7  or a county may not release the name or address of a person
    1-8  recorded in the department vessel and outboard motor ownership
    1-9  records unless the department or county receives a written request
   1-10  that:
   1-11              (1)  contains the requestor's name and address; and
   1-12              (2)  states that the use of the information is for a
   1-13  lawful purpose.
   1-14        (b)  This section does not apply to the release of
   1-15  information to:
   1-16              (1)  a peace officer as defined by Article 2.12, Code
   1-17  of Criminal Procedure, who is acting in an official capacity; or
   1-18              (2)  a state official or an official of a political
   1-19  subdivision of this state who requests the information for tax
   1-20  purposes.
   1-21        SECTION 2.  This Act takes effect September 1, 1995.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
