No. 72 74R1934 PAM-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the release of information kept in vessel and boat 1-3 records. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter B, Chapter 31, Parks and Wildlife 1-6 Code, is amended by adding Section 31.0391 to read as follows: 1-7 Sec. 31.0391. RELEASE OF INFORMATION. (a) The department 1-8 or a county may not release the name or address of a person 1-9 recorded in the department vessel and outboard motor ownership 1-10 records unless the department or county receives a written request 1-11 that: 1-12 (1) contains the requestor's name and address; and 1-13 (2) states that the use of the information is for a 1-14 lawful purpose. 1-15 (b) This section does not apply to the release of 1-16 information to: 1-17 (1) a peace officer as defined by Article 2.12, Code 1-18 of Criminal Procedure, who is acting in an official capacity; or 1-19 (2) a state official or an official of a political 1-20 subdivision of this state who requests the information for tax 1-21 purposes. 1-22 SECTION 2. This Act takes effect September 1, 1995. 1-23 SECTION 3. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 2-1 emergency and an imperative public necessity that the 2-2 constitutional rule requiring bills to be read on three several 2-3 days in each house be suspended, and this rule is hereby suspended.
