                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to indicating a condition of community supervision on the
    1-3  driver's license of persons convicted of certain offenses.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 13, Article 42.12, Code of Criminal
    1-6  Procedure, is amended by adding Subsection (m) to read as follows:
    1-7        (m)(1)  This subsection applies only to a defendant convicted
    1-8  of an offense under Chapter 49, Penal Code, involving the operation
    1-9  of a motor vehicle, whose driver's license is not suspended as a
   1-10  result of the conviction and who, as a condition of community
   1-11  supervision, is prohibited from consuming alcoholic beverages.
   1-12              (2)  The judge shall require that the defendant
   1-13  surrender the defendant's driver's license to the court and be
   1-14  issued by the Department of Public Safety a new driver's license
   1-15  that:
   1-16                    (A)  identifies the licensee as a person placed
   1-17  on community supervision for an offense under Chapter 49, Penal
   1-18  Code; and
   1-19                    (B)  shows that as a condition of community
   1-20  supervision, the licensee is prohibited from consuming alcoholic
   1-21  beverages.
   1-22        SECTION 2.  This Act takes effect September 1, 1995, and
   1-23  applies only to a person placed on community supervision on or
    2-1  after that date.
    2-2        SECTION 3.  The importance of this legislation and the
    2-3  crowded condition of the calendars in both houses create an
    2-4  emergency and an imperative public necessity that the
    2-5  constitutional rule requiring bills to be read on three several
    2-6  days in each house be suspended, and this rule is hereby suspended.
