                                        AN ACT
    1-1  relating to fees on conviction to reimburse the state and political
    1-2  subdivisions for overtime pay for peace officers who testify at
    1-3  trial.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Article 102.011, Code of Criminal Procedure, is
    1-6  amended by adding Subsection (i) to read as follows:
    1-7        (i)  In addition to fees provided by Subsections (a) through
    1-8  (g) of this article, a defendant required to pay fees under this
    1-9  article shall also pay the costs of overtime paid to a peace
   1-10  officer for time spent testifying in the trial of the case or for
   1-11  traveling to or from testifying in the trial of the case.
   1-12        SECTION 2.  (a)  The change in law made by this Act applies
   1-13  only to a fee on conviction for an offense committed on or after
   1-14  the effective date of this Act.  For purposes of this section, an
   1-15  offense is committed before the effective date of this Act if any
   1-16  element of the offense occurs before the effective date.
   1-17        (b)  A fee on conviction for an offense committed before the
   1-18  effective date of this Act is covered by the law in effect when the
   1-19  offense was committed, and the former law is continued in effect
   1-20  for this purpose.
   1-21        SECTION 3.  This Act takes effect September 1, 1995.
   1-22        SECTION 4.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
