                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the operation and expansion of the Communities in
    1-3  Schools program.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 216.021, Labor Code, is amended to read
    1-6  as follows:
    1-7        Sec. 216.021.  DESIGNATION OF PARTICIPATING SCHOOLS.
    1-8  (a)  The state coordinator, in cooperation with the program
    1-9  directors in the counties or cities in which a Communities in
   1-10  Schools program is located, <was established on September 1, 1991,>
   1-11  shall designate:
   1-12              (1)  not more than 244 campuses in counties or cities
   1-13  that were participating in the program on September 1, 1993, for
   1-14  continued funding for participation in the program; and
   1-15              (2)  not more than 135 additional campuses in
   1-16  designated counties or cities for funding for participation in the
   1-17  program <32 elementary schools and 76 secondary schools in those
   1-18  counties to participate in the program>.
   1-19        (b)  The state coordinator shall designate six<, in
   1-20  cooperation with the program directors in four> additional counties
   1-21  or cities for participation  <designated by the state coordinator,
   1-22  shall designate additional elementary and secondary schools to
   1-23  participate> in the Communities in Schools program.
   1-24        <(c)  The designation of secondary schools to participate in
    2-1  the Communities in Schools program must be distributed among high
    2-2  schools and junior high or middle schools.>
    2-3        SECTION 2.  Chapter 216, Labor Code, is amended by adding
    2-4  Subchapter E to read as follows:
    2-5              SUBCHAPTER E.  BUSINESS FOUNDATION COUNCIL
    2-6        Sec. 216.041.  BUSINESS FOUNDATION COUNCIL.  (a)  The
    2-7  business foundation council is established as a resource group for
    2-8  the Communities in Schools program.  The council is composed of 15
    2-9  members appointed by the governor.
   2-10        (b)  Members of the council serve staggered six-year terms,
   2-11  with the terms of five members expiring on February 1 of each
   2-12  odd-numbered year.
   2-13        (c)  A member of the council is not entitled to compensation
   2-14  for service on the council but is entitled to reimbursement for
   2-15  actual and necessary expenses incurred in performing duties as a
   2-16  council member, subject to any applicable limitation in the General
   2-17  Appropriations Act.
   2-18        (d)  The members of the council shall elect one member to
   2-19  serve as presiding officer for a term of four years.
   2-20        (e)  In the event of a vacancy on the council, the governor
   2-21  shall appoint a member to fill the vacancy from names presented by
   2-22  the council.
   2-23        (f)  Section 8, Chapter 398, Acts of the 73rd Legislature,
   2-24  1993 (Article 6252-33, Vernon's Texas Civil Statutes), does not
   2-25  apply to the council.
   2-26        Sec. 216.042.  COUNCIL DUTIES.  The business foundation
   2-27  council shall:
    3-1              (1)  provide strategic direction to the Communities in
    3-2  Schools program;
    3-3              (2)  encourage partnerships between the public and
    3-4  private sectors to assist in the accomplishment of the goals of the
    3-5  Communities in Schools program;
    3-6              (3)  provide support for statewide fund-raising efforts
    3-7  for the Communities in Schools program; and
    3-8              (4)  assist in the development of long-range planning
    3-9  for the operation of the Communities in Schools program.
   3-10        SECTION 3.  Funding for the expansion of the Communities in
   3-11  Schools program as provided by this Act shall be accomplished by
   3-12  setting aside from funds allocated under Section 16.152, Education
   3-13  Code:
   3-14              (1)  $18 million in the first year of the 1996-1997
   3-15  state fiscal biennium; and
   3-16              (2)  $21.2 million in the second year of the 1996-1997
   3-17  state fiscal biennium.
   3-18        SECTION 4.   This Act takes effect September 1, 1995.
   3-19        SECTION 5.  The importance of this legislation and the
   3-20  crowded condition of the calendars in both houses create an
   3-21  emergency and an imperative public necessity that the
   3-22  constitutional rule requiring bills to be read on three several
   3-23  days in each house be suspended, and this rule is hereby suspended.
