AN ACT
1-1 relating to the change of the name of the San Antonio State Chest
1-2 Hospital to the Texas Center for Infectious Disease.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subsection (a), Section 11.004, Health and Safety
1-5 Code, is amended to read as follows:
1-6 (a) The department is composed of the board, the
1-7 commissioner, an administrative staff, the Texas Center for
1-8 Infectious Disease <San Antonio State Chest Hospital>, the South
1-9 Texas Hospital, and other officers and employees necessary to
1-10 perform efficiently its powers and duties.
1-11 SECTION 2. Subsections (a) and (c), Section 13.004, Health
1-12 and Safety Code, are amended to read as follows:
1-13 (a) The Texas Department of Mental Health and Mental
1-14 Retardation may transfer a mentally ill or mentally retarded person
1-15 who is infected with tuberculosis to the Texas Center for
1-16 Infectious Disease <San Antonio State Chest Hospital>.
1-17 (c) The cost of maintaining and treating the person at the
1-18 Texas Center for Infectious Disease <San Antonio State Chest
1-19 Hospital> shall be paid from appropriations to that hospital.
1-20 SECTION 3. Section 13.007, Health and Safety Code, is
1-21 amended to read as follows:
1-22 Sec. 13.007. MEDICAL SERVICES TRUST FUND. The medical
1-23 services trust fund is created as a special account in the general
1-24 revenue fund. Fees and charges collected for physicians' services
2-1 provided at the South Texas Hospital and the Texas Center for
2-2 Infectious Disease <San Antonio State Chest Hospital> shall be
2-3 deposited to the account.
2-4 SECTION 4. Section 13.008, Health and Safety Code, is
2-5 amended to read as follows:
2-6 Sec. 13.008. USE OF MEDICAL SERVICES TRUST FUND. (a) The
2-7 medical services trust fund shall be used for recruiting and
2-8 retaining medical staff at the South Texas Hospital and the Texas
2-9 Center for Infectious Disease <San Antonio State Chest Hospital>
2-10 and supplementing their salaries.
2-11 (b) In addition to other authorized uses, the medical
2-12 services trust fund may be used to supplement salaries of nurses
2-13 and other medical personnel at the South Texas Hospital and the
2-14 Texas Center for Infectious Disease <San Antonio State Chest
2-15 Hospital>.
2-16 SECTION 5. Subdivision (5), Section 13.033, Health and
2-17 Safety Code, is amended to read as follows:
2-18 (5) "State chest hospital" means the Texas Center for
2-19 Infectious Disease <San Antonio State Chest Hospital> and the South
2-20 Texas Hospital.
2-21 SECTION 6. Subsection (a), Section 13.071, Health and Safety
2-22 Code, is amended to read as follows:
2-23 (a) In addition to treating tuberculosis, the South Texas
2-24 Hospital and the Texas Center for Infectious Disease <San Antonio
2-25 State Chest Hospital> may operate a pilot program to treat persons
2-26 afflicted with other chronic respiratory diseases.
2-27 SECTION 7. Subsection (a), Section 13.074, Health and Safety
3-1 Code, is amended to read as follows:
3-2 (a) The South Texas Hospital and the Texas Center for
3-3 Infectious Disease <San Antonio State Chest Hospital> may treat not
3-4 more than 25 patients at any one time under the pilot program
3-5 unless the treatment of a greater number of patients does not
3-6 conflict with the primary objectives of the tuberculosis control
3-7 program.
3-8 SECTION 8. Subsection (b), Section 553.022, Health and
3-9 Safety Code, is amended to read as follows:
3-10 (b) The Texas Department of Mental Health and Mental
3-11 Retardation may enter into agreements with the Texas Department of
3-12 Health for use of the excess facilities of the Texas Center for
3-13 Infectious Disease <San Antonio Chest Hospital> in the operation of
3-14 the school.
3-15 SECTION 9. (a) The name of the San Antonio State Chest
3-16 Hospital is changed to the Texas Center for Infectious Disease.
3-17 (b) A reference in law to the San Antonio State Chest
3-18 Hospital is a reference to the Texas Center for Infectious Disease.
3-19 (c) An appropriation for the use and benefit of the San
3-20 Antonio State Chest Hospital is available for the use and benefit
3-21 of the Texas Center for Infectious Disease.
3-22 (d) Before using new stationery or other supplies printed
3-23 with the hospital's name as changed by this Act, the hospital shall
3-24 use all stationery and other supplies that are printed with the
3-25 hospital's former name and that are in its possession on the
3-26 effective date of this Act.
3-27 SECTION 10. This Act takes effect September 1, 1995.
4-1 SECTION 11. The importance of this legislation and the
4-2 crowded condition of the calendars in both houses create an
4-3 emergency and an imperative public necessity that the
4-4 constitutional rule requiring bills to be read on three several
4-5 days in each house be suspended, and this rule is hereby suspended.
