    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to the change of the name of the San Antonio State Chest
    1-9  Hospital to the Texas Center for Infectious Disease.
   1-10        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-11        SECTION 1.  Subsection (a), Section 11.004, Health and Safety
   1-12  Code, is amended to read as follows:
   1-13        (a)  The department is composed of the board, the
   1-14  commissioner, an administrative staff, the Texas Center for
   1-15  Infectious Disease <San Antonio State Chest Hospital>, the South
   1-16  Texas Hospital, and other officers and employees necessary to
   1-17  perform efficiently its powers and duties.
   1-18        SECTION 2.  Subsections (a) and (c), Section 13.004, Health
   1-19  and Safety Code, are amended to read as follows:
   1-20        (a)  The Texas Department of Mental Health and Mental
   1-21  Retardation may transfer a mentally ill or mentally retarded person
   1-22  who is infected with tuberculosis to the Texas Center for
   1-23  Infectious Disease <San Antonio State Chest Hospital>.
   1-24        (c)  The cost of maintaining and treating the person at the
   1-25  Texas Center for Infectious Disease <San Antonio State Chest
   1-26  Hospital> shall be paid from appropriations to that hospital.
   1-27        SECTION 3.  Section 13.007, Health and Safety Code, is
   1-28  amended to read as follows:
   1-29        Sec. 13.007.  MEDICAL SERVICES TRUST FUND.  The medical
   1-30  services trust fund is created as a special account in the general
   1-31  revenue fund.  Fees and charges collected for physicians' services
   1-32  provided at the South Texas Hospital and the Texas Center for
   1-33  Infectious Disease <San Antonio State Chest Hospital> shall be
   1-34  deposited to the account.
   1-35        SECTION 4.  Section 13.008, Health and Safety Code, is
   1-36  amended to read as follows:
   1-37        Sec. 13.008.  USE OF MEDICAL SERVICES TRUST FUND.  (a)  The
   1-38  medical services trust fund shall be used for recruiting and
   1-39  retaining medical staff at the South Texas Hospital and the Texas
   1-40  Center for Infectious Disease <San Antonio State Chest Hospital>
   1-41  and supplementing their salaries.
   1-42        (b)  In addition to other authorized uses, the medical
   1-43  services trust fund may be used to supplement salaries of nurses
   1-44  and other medical personnel at the South Texas Hospital and the
   1-45  Texas Center for Infectious Disease <San Antonio State Chest
   1-46  Hospital>.
   1-47        SECTION 5.  Subdivision (5), Section 13.033, Health and
   1-48  Safety Code, is amended to read as follows:
   1-49              (5)  "State chest hospital" means the Texas Center for
   1-50  Infectious Disease <San Antonio State Chest Hospital> and the South
   1-51  Texas Hospital.
   1-52        SECTION 6.  Subsection (a), Section 13.071, Health and Safety
   1-53  Code, is amended to read as follows:
   1-54        (a)  In addition to treating tuberculosis, the South Texas
   1-55  Hospital and the Texas Center for Infectious Disease <San Antonio
   1-56  State Chest Hospital> may operate a pilot program to treat persons
   1-57  afflicted with other chronic respiratory diseases.
   1-58        SECTION 7.  Subsection (a), Section 13.074, Health and Safety
   1-59  Code, is amended to read as follows:
   1-60        (a)  The South Texas Hospital and the Texas Center for
   1-61  Infectious Disease <San Antonio State Chest Hospital> may treat not
   1-62  more than 25 patients at any one time under the pilot program
   1-63  unless the treatment of a greater number of patients does not
   1-64  conflict with the primary objectives of the tuberculosis control
   1-65  program.
   1-66        SECTION 8.  Subsection (b), Section 553.022, Health and
   1-67  Safety Code, is amended to read as follows:
   1-68        (b)  The Texas Department of Mental Health and Mental
    2-1  Retardation may enter into agreements with the Texas Department of
    2-2  Health for use of the excess facilities of the Texas Center for
    2-3  Infectious Disease <San Antonio Chest Hospital> in the operation of
    2-4  the school.
    2-5        SECTION 9.  (a)  The name of the San Antonio State Chest
    2-6  Hospital is changed to the Texas Center for Infectious Disease.
    2-7        (b)  A reference in law to the San Antonio State Chest
    2-8  Hospital is a reference to the Texas Center for Infectious Disease.
    2-9        (c)  An appropriation for the use and benefit of the San
   2-10  Antonio State Chest Hospital is available for the use and benefit
   2-11  of the Texas Center for Infectious Disease.
   2-12        (d)  Before using new stationery or other supplies printed
   2-13  with the hospital's name as changed by this Act, the hospital shall
   2-14  use all stationery and other supplies that are printed with the
   2-15  hospital's former name and that are in its possession on the
   2-16  effective date of this Act.
   2-17        SECTION 10.  This Act takes effect September 1, 1995.
   2-18        SECTION 11.  The importance of this legislation and the
   2-19  crowded condition of the calendars in both houses create an
   2-20  emergency and an imperative public necessity that the
   2-21  constitutional rule requiring bills to be read on three several
   2-22  days in each house be suspended, and this rule is hereby suspended.
