A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the abolition of certain district courts, the creation
1-3 of additional district courts, and the election of district court
1-4 judges in certain counties.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. (a) For district court elections in the counties
1-7 named in this Act in 1996 and thereafter, judges shall be elected
1-8 from election subdistricts as assigned by the legislature.
1-9 (b) The legislature finds that this Act is consistent with
1-10 all provisions of the Texas Constitution.
1-11 SECTION 2. Subchapter A, Chapter 24, Government Code, is
1-12 amended by adding Section 24.0015 to read as follows:
1-13 Sec. 24.0015. RESIDENCY REQUIREMENT OF JUDGES. A district
1-14 judge elected by place from an area that is less than the entire
1-15 judicial district may, but need not, be a resident of the area from
1-16 which elected.
1-17 SECTION 3. Effective January 1, 1997, Subchapter C, Chapter
1-18 24, Government Code, is amended by adding Sections 24.523-24.5291
1-19 to read as follows:
1-20 Sec. 24.523. 11TH JUDICIAL DISTRICT (HARRIS COUNTY). (a)
1-21 The 11th Judicial District is composed of Harris County.
1-22 (b) The district has 25 judges who are elected by place as
1-23 provided by Subsection (c). For purposes of this section, a state
1-24 representative district is composed of the area in the district on
2-1 September 2, 1995.
2-2 (c) One judge shall be elected for each of the following
2-3 places:
2-4 (1) place 1 shall be elected by voters residing in
2-5 state representative district 126;
2-6 (2) place 2 shall be elected by voters residing in
2-7 state representative district 127;
2-8 (3) place 3 shall be elected by voters residing in
2-9 state representative district 128;
2-10 (4) place 4 shall be elected by voters residing in
2-11 state representative district 129;
2-12 (5) place 5 shall be elected by voters residing in
2-13 state representative district 130;
2-14 (6) place 6 shall be elected by voters residing in
2-15 state representative district 131;
2-16 (7) place 7 shall be elected by voters residing in
2-17 state representative district 132;
2-18 (8) place 8 shall be elected by voters residing in
2-19 state representative district 133;
2-20 (9) place 9 shall be elected by voters residing in
2-21 state representative district 134;
2-22 (10) place 10 shall be elected by voters residing in
2-23 state representative district 135;
2-24 (11) place 11 shall be elected by voters residing in
2-25 state representative district 136;
2-26 (12) place 12 shall be elected by voters residing in
2-27 state representative district 137;
3-1 (13) place 13 shall be elected by voters residing in
3-2 state representative district 138;
3-3 (14) place 14 shall be elected by voters residing in
3-4 state representative district 139;
3-5 (15) place 15 shall be elected by voters residing in
3-6 state representative district 140;
3-7 (16) place 16 shall be elected by voters residing in
3-8 state representative district 141;
3-9 (17) place 17 shall be elected by voters residing in
3-10 state representative district 142;
3-11 (18) place 18 shall be elected by voters residing in
3-12 state representative district 143;
3-13 (19) place 19 shall be elected by voters residing in
3-14 state representative district 144;
3-15 (20) place 20 shall be elected by voters residing in
3-16 state representative district 145;
3-17 (21) place 21 shall be elected by voters residing in
3-18 state representative district 146;
3-19 (22) place 22 shall be elected by voters residing in
3-20 state representative district 147;
3-21 (23) place 23 shall be elected by voters residing in
3-22 state representative district 148;
3-23 (24) place 24 shall be elected by voters residing in
3-24 state representative district 149; and
3-25 (25) place 25 shall be elected by voters residing in
3-26 state representative district 150.
3-27 Sec. 24.524. 14TH JUDICIAL DISTRICT (DALLAS COUNTY). (a)
4-1 The 14th Judicial District is composed of Dallas County.
4-2 (b) The district has seven judges who are elected by place
4-3 as provided by Subsection (c). For purposes of this section, a
4-4 state representative district or commissioners court precinct is
4-5 composed of the area in the district or precinct on September 2,
4-6 1995.
4-7 (c) One judge shall be elected for each of the following
4-8 places:
4-9 (1) place 1 shall be elected by voters residing in
4-10 state representative district 100;
4-11 (2) place 2 shall be elected by voters residing in
4-12 state representative district 104;
4-13 (3) place 3 shall be elected by voters residing in
4-14 state representative district 109;
4-15 (4) place 4 shall be elected by voters residing in
4-16 state representative district 110;
4-17 (5) place 5 shall be elected by voters residing in
4-18 state representative district 111;
4-19 (6) place 6 shall be elected by voters residing in
4-20 state representative district 113; and
4-21 (7) place 7 shall be elected by voters residing in
4-22 state representative district 114.
4-23 Sec. 24.525. 17TH JUDICIAL DISTRICT (TARRANT COUNTY). (a)
4-24 The 17th Judicial District is composed of Tarrant County.
4-25 (b) The district has 11 judges who are elected by place as
4-26 provided by Subsection (c). For purposes of this section, a state
4-27 representative district is composed of the area in the district on
5-1 September 2, 1995.
5-2 (c) One judge shall be elected for each of the following
5-3 places:
5-4 (1) place 1 shall be elected by voters residing in
5-5 state representative district 89;
5-6 (2) place 2 shall be elected by voters residing in
5-7 state representative district 90;
5-8 (3) place 3 shall be elected by voters residing in
5-9 state representative district 91;
5-10 (4) place 4 shall be elected by voters residing in
5-11 state representative district 92;
5-12 (5) place 5 shall be elected by voters residing in
5-13 state representative district 93;
5-14 (6) place 6 shall be elected by voters residing in
5-15 state representative district 94;
5-16 (7) place 7 shall be elected by voters residing in
5-17 state representative district 95;
5-18 (8) place 8 shall be elected by voters residing in
5-19 state representative district 96;
5-20 (9) place 9 shall be elected by voters residing in
5-21 state representative district 97;
5-22 (10) place 10 shall be elected by voters residing in
5-23 state representative district 98; and
5-24 (11) place 11 shall be elected by voters residing in
5-25 state representative districts 90 and 95.
5-26 Sec. 24.526. 37TH JUDICIAL DISTRICT (BEXAR COUNTY). (a)
5-27 The 37th Judicial District is composed of Bexar County.
6-1 (b) The district has six judges who are elected by place as
6-2 provided by Subsection (c). For purposes of this section, a state
6-3 representative district or commissioners court precinct is composed
6-4 of the area in the district or precinct on September 2, 1995.
6-5 (c) One judge shall be elected for each of the following
6-6 places:
6-7 (1) place 1 shall be elected by voters residing in
6-8 Commissioners Court Precinct No. 1;
6-9 (2) place 2 shall be elected by voters residing in
6-10 Commissioners Court Precinct No. 2;
6-11 (3) place 3 shall be elected by voters residing in
6-12 Commissioners Court Precinct No. 3;
6-13 (4) place 4 shall be elected by voters residing in
6-14 Commissioners Court Precinct No. 4;
6-15 (5) place 5 shall be elected by voters residing in
6-16 state representative district 115; and
6-17 (6) place 6 shall be elected by voters residing in
6-18 state representative district 116.
6-19 Sec. 24.527. 60TH JUDICIAL DISTRICT (JEFFERSON COUNTY). (a)
6-20 The 60th Judicial District is composed of Jefferson County.
6-21 (b) The district has two judges who are elected by place as
6-22 provided by Subsection (c). For purposes of this section, a state
6-23 representative district or commissioners court precinct is composed
6-24 of the area in the district or precinct on September 2, 1995.
6-25 (c) One judge shall be elected for each of the following
6-26 places:
6-27 (1) place 1 shall be elected by voters residing in
7-1 state representative district 22; and
7-2 (2) place 2 shall be elected by voters residing in
7-3 state representative district 21 and the voters residing in that
7-4 part of state representative district 19 in Jefferson County.
7-5 Sec. 24.528. 99TH JUDICIAL DISTRICT (LUBBOCK COUNTY). (a)
7-6 The 99th Judicial District is composed of Lubbock County.
7-7 (b) The district has three judges who are elected by place
7-8 as provided by Subsection (c). For purposes of this section, a
7-9 state representative district or commissioners court precinct is
7-10 composed of the area in the district or precinct on September 2,
7-11 1995.
7-12 (c) One judge shall be elected for each of the following
7-13 places:
7-14 (1) place 1 shall be elected by voters residing in
7-15 Commissioners Court Precinct No. 1;
7-16 (2) place 2 shall be elected by voters residing in
7-17 Commissioners Court Precinct No. 2; and
7-18 (3) place 3 shall be elected by voters residing in
7-19 Commissioners Court Precinct No. 3.
7-20 Sec. 24.529. 70TH JUDICIAL DISTRICT (ECTOR COUNTY). (a)
7-21 The 70th Judicial District is composed of Ector County.
7-22 (b) The district has two judges who are elected by place as
7-23 provided by Subsection (c). For purposes of this section, a
7-24 commissioners court precinct is composed of the area in the
7-25 precinct on September 2, 1995.
7-26 (c) One judge shall be elected for each of the following
7-27 places:
8-1 (1) place 1 shall be elected by voters residing in
8-2 Commissioners Court Precinct No. 1; and
8-3 (2) place 2 shall be elected by voters residing in
8-4 Commissioners Court Precinct No. 2.
8-5 Sec. 24.5291. 142ND JUDICIAL DISTRICT (MIDLAND COUNTY). (a)
8-6 The 142nd Judicial District is composed of Midland County.
8-7 (b) The district has two judges who are elected by place as
8-8 provided by Subsection (c). For purposes of this section, a
8-9 commissioners court precinct is composed of the area in the
8-10 precinct on September 2, 1995.
8-11 (c) One judge shall be elected for each of the following
8-12 places:
8-13 (1) place 1 shall be elected by voters residing in
8-14 Commissioners Court Precinct No. 3; and
8-15 (2) place 2 shall be elected by voters residing in
8-16 Commissioners Court Precinct No. 4.
8-17 SECTION 4. Effective January 1, 1999, Sections 24.523(b) and
8-18 (c), Government Code, as added by Section 3 of this Act, are
8-19 amended to read as follows:
8-20 (b) The district has 60 <25> judges who are elected by place
8-21 as provided by Subsection (c). For purposes of this section, a
8-22 state representative district is composed of the area in the
8-23 district on September 2, 1995.
8-24 (c) One judge shall be elected for each of the following
8-25 places:
8-26 (1) places <place> 1 and 26 shall be elected by voters
8-27 residing in state representative district 126;
9-1 (2) places <place> 2 and 27 shall be elected by voters
9-2 residing in state representative district 127;
9-3 (3) places <place> 3 and 28 shall be elected by voters
9-4 residing in state representative district 128;
9-5 (4) places <place> 4 and 29 shall be elected by voters
9-6 residing in state representative district 129;
9-7 (5) places <place> 5 and 30 shall be elected by voters
9-8 residing in state representative district 130;

11-8 residing in state representative districts 140, 143, 144, 145, and
11-9 148.
11-10 SECTION 5. Effective January 1, 1999, Sections 24.524(b) and
11-11 (c), Government Code, as added by Section 3 of this Act, are
11-12 amended to read as follows:
11-13 (b) The district has 40 <seven> judges who are elected by
11-14 place as provided by Subsection (c). For purposes of this section,
11-15 a state representative district or commissioners court precinct is
11-16 composed of the area in the district or precinct on September 2,
11-17 1995.
11-18 (c) One judge shall be elected for each of the following
11-19 places:
11-20 (1) places <place> 1 and 17 shall be elected by voters
11-21 residing in state representative district 100;
11-22 (2) places <place> 2 and 18 shall be elected by voters
11-23 residing in state representative district 104;
11-24 (3) places <place> 3 and 19 shall be elected by voters
11-25 residing in state representative district 109;

13-19 state representative district is composed of the area in the
13-20 district on September 2, 1995.
13-21 (c) One judge shall be elected for each of the following

15-7 (c) One judge shall be elected for each of the following
15-8 places:
15-9 (1) places <place> 1 and 19 shall be elected by voters
15-10 residing in Commissioners Court Precinct No. 1;

16-16 place as provided by Subsection (c). For purposes of this section,
16-17 a state representative district or commissioners court precinct is
16-18 composed of the area in the district or precinct on September 2,
16-19 1995.
16-20 (c) One judge shall be elected for each of the following
16-21 places:
16-22 (1) places <place> 1 and 3 shall be elected by voters
16-23 residing in state representative district 22; <and>
16-24 (2) places <place> 2 and 4 shall be elected by voters
16-25 residing in state representative district 21 and the voters
16-26 residing in that part of state representative district 19 in
16-27 Jefferson County;
17-1 (3) place 5 shall be elected by voters residing in
17-2 Commissioners Court Precinct No. 1;
17-3 (4) place 6 shall be elected by voters residing in
17-4 Commissioners Court Precinct No. 2;
17-5 (5) place 7 shall be elected by voters residing in
17-6 Commissioners Court Precinct No. 3; and

17-9 SECTION 9. Effective January 1, 1999, Section 24.528,
17-10 Government Code, as added by Section 3 of this Act, is amended to
17-11 read as follows:
17-12 Sec. 24.528. 99TH JUDICIAL DISTRICT (LUBBOCK AND CROSBY
17-13 COUNTIES <COUNTY>). (a) The 99th Judicial District is composed of
17-14 Lubbock and Crosby counties <County>.
17-15 (b) The district has six <three> judges who are elected by
17-16 place as provided by Subsection (c). For purposes of this section,
17-17 a state representative district or commissioners court precinct is
17-18 composed of the area in the district or precinct on September 2,
17-19 1995.
17-20 (c) One judge shall be elected for each of the following
17-21 places:
17-22 (1) place 1 shall be elected by voters residing in
17-23 Lubbock County Commissioners Court Precinct No. 1;
17-24 (2) place 2 shall be elected by voters residing in
17-25 Lubbock County Commissioners Court Precinct No. 2; <and>
17-26 (3) place 3 shall be elected by voters residing in
17-27 Lubbock County Commissioners Court Precinct No. 3;
18-1 (4) place 4 shall be elected by voters residing in
18-2 Lubbock County Commissioners Court Precinct No. 4;
18-3 (5) place 5 shall be elected by voters residing in
18-4 state representative district 83; and
18-5 (6) place 6 shall be elected by voters residing in
18-6 state representative district 84 and Crosby County.
18-7 SECTION 10. Effective January 1, 1999, Sections 24.529(b)
18-8 and (c), Government Code, as added by Section 3 of this Act, are
18-9 amended to read as follows:
18-10 (b) The district has four <two> judges who are elected by
18-11 place as provided by Subsection (c). For purposes of this section,
18-12 a commissioners court precinct is composed of the area in the
18-13 precinct on September 2, 1995.
18-14 (c) One judge shall be elected for each of the following
18-15 places:
18-16 (1) place 1 shall be elected by voters residing in
18-17 Commissioners Court Precinct No. 1; <and>
18-18 (2) place 2 shall be elected by voters residing in

19-11 Commissioners Court Precinct No. 1; and
19-12 (4) place 4 shall be elected by voters residing in
19-13 Commissioners Court Precinct No. 2.
19-14 SECTION 12. (a) Effective January 1, 1997, the following
19-15 sections of the Government Code are repealed:
19-16 (1) 24.112, 24.163, 24.182, 24.227, 24.229, 24.231,
19-17 24.235, 24.250, 24.251, 24.261, 24.262, 24.267, 24.269, 24.270,
19-18 24.271, 24.272, 24.369, 24.394, 24.479, 24.480, 24.483, 24.484,

19-20 (2) 24.115, 24.197, 24.259, 24.374, 24.902, 24.903,

20-3 (b) A judicial district created by a section of the
20-4 Government Code that is repealed by Subsection (a) of this section
20-5 is abolished January 1, 1997.
20-6 SECTION 13. (a) Effective January 1, 1999, the following
20-7 sections of the Government Code are repealed:

20-26 (b) A judicial district created by a section of the
20-27 Government Code that is repealed by Subsection (a) of this section
21-1 is abolished January 1, 1999.
21-2 SECTION 14. (a) The judicial offices created by Section 3
21-3 of this Act exist for purposes of the primary and general elections
21-4 for state and county officers in 1996.
21-5 (b) Not later than December 15, 1996, the judge of a
21-6 district court that is abolished by Section 12 of this Act shall
21-7 transfer all cases pending in the court to another district court
21-8 in the county. The court to which the cases are transferred may
21-9 not be a court that is abolished by Section 12 of this Act.
21-10 (c) The judicial offices created by Sections 4-11 of this
21-11 Act exist for purposes of the primary and general elections for
21-12 state and county officers in 1998.
21-13 (d) Not later than December 15, 1998, the judge of a
21-14 district court that is abolished by Section 13 of this Act shall
21-15 transfer all cases pending in the court to another district court
21-16 in the county that is created by Section 3 of this Act.
21-17 (e) When a case is transferred from one court to another as
21-18 provided by Subsection (b) or (d) of this section, all processes,
21-19 writs, bonds, recognizances, or other obligations issued from the
21-20 transferring court are returnable to the court to which the case is
21-21 transferred as if originally issued by that court. The obligees in
21-22 all bonds and recognizances taken in and for a court from which a
21-23 case is transferred, and all witnesses summoned to appear in a
21-24 court from which a case is transferred, are required to appear
21-25 before the court to which a case is transferred as if originally
21-26 required to appear before the court to which the transfer is made.
21-27 SECTION 15. Except as provided by Sections 3-11, 12(a), and
22-1 13(a) of this Act, this Act takes effect September 1, 1995.
22-2 SECTION 16. The importance of this legislation and the
22-3 crowded condition of the calendars in both houses create an
22-4 emergency and an imperative public necessity that the
22-5 constitutional rule requiring bills to be read on three several
22-6 days in each house be suspended, and this rule is hereby suspended.
