    1-6                         A BILL TO BE ENTITLED
    1-7                                AN ACT
    1-8  relating to the testing of gas well deliverability and pressure.
    1-9        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-10        SECTION 1.  Section 86.141, Natural Resources Code, is
   1-11  amended to read as follows:
   1-12        Sec. 86.141.  DUTY TO TEST GAS WELLS <PRESSURE>.  The
   1-13  commission may require <All> persons producing gas from any gas
   1-14  well to <shall> determine periodically through an appropriate test
   1-15  <tests during the months of January and July of each year> the
   1-16  deliverability and wellhead <open flow and rock> pressure of each
   1-17  gas well from which gas is produced.
   1-18        SECTION 2.  Section 86.142, Natural Resources Code, is
   1-19  amended to read as follows:
   1-20        Sec. 86.142.  <PRESSURE> TEST REQUIREMENTS.  A <The> test to
   1-21  determine the deliverability and pressure of a gas well shall be
   1-22  made:
   1-23              (1)  under uniform and generally recognized methods;
   1-24  and
   1-25              (2)  <in the presence of and under the supervision of a
   1-26  representative of the commission; and>
   1-27              <(3)>  under rules prescribed by the commission.
   1-28        SECTION 3.  Section 86.143, Natural Resources Code, is
   1-29  amended to read as follows:
   1-30        Sec. 86.143.  <PRESSURE> TEST REPORTS.  (a)  Verified reports
   1-31  of the tests to determine deliverability and pressure shall be
   1-32  filed with the commission within a time period after the end of the
   1-33  test period as set by the commission <on or before the 10th day of
   1-34  each January and July>.
   1-35        (b)  <The reports shall disclose the name of the
   1-36  representative of the commission who was actually present when the
   1-37  tests were made.>
   1-38        <(c)>  The reports are a <permanent> public record.  They
   1-39  shall be kept on file with the commission for a period of time
   1-40  determined by the commission and shall be open to the inspection
   1-41  and examination of the public.
   1-42        SECTION 4.  This Act takes effect September 1, 1995.
   1-43        SECTION 5.  The importance of this legislation and the
   1-44  crowded condition of the calendars in both houses create an
   1-45  emergency and an imperative public necessity that the
   1-46  constitutional rule requiring bills to be read on three several
   1-47  days in each house be suspended, and this rule is hereby suspended.
