AN ACT
1-1 relating to the review and continuation of certain state agencies
1-2 subject to the Texas Sunset Act.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 ARTICLE 1. 1997 AGENCIES
1-5 SECTION 1.01. Section 461.004, Health and Safety Code, is
1-6 amended to read as follows:
1-7 Sec. 461.004. Application of Sunset Act. The Texas
1-8 Commission on Alcohol and Drug Abuse is subject to Chapter 325,
1-9 Government Code (Texas Sunset Act). Unless continued in existence
1-10 as provided by that chapter, the commission is abolished and this
1-11 chapter expires September 1, 1997 <1999>.
1-12 SECTION 1.02. Section 141.012, Human Resources Code, is
1-13 amended to read as follows:
1-14 Sec. 141.012. Sunset Provision. The Texas Juvenile
1-15 Probation Commission is subject to Chapter 325, Government Code
1-16 (Texas Sunset Act). Unless continued in existence as provided by
1-17 that chapter, the commission is abolished and this chapter expires
1-18 September 1, 1997 <1999>.
1-19 SECTION 1.03. Section 8, Article 4413(503), Revised
1-20 Statutes, is amended to read as follows:
1-21 Sec. 8. Sunset Provision. The Department of Protective and
1-22 Regulatory Services is subject to Chapter 325, Government Code
1-23 (Texas Sunset Act). Unless continued in existence as provided by
2-1 that chapter, the department is abolished and this article expires
2-2 September 1, 1997 <1999>.
2-3 SECTION 1.04. Section 61.020, Human Resources Code, is
2-4 amended to read as follows:
2-5 Sec. 61.020. Sunset Provision. The Texas Youth Commission
2-6 is subject to Chapter 325, Government Code (Texas Sunset Act).
2-7 Unless continued in existence as provided by that chapter, the
2-8 commission is abolished and this chapter expires September 1, 1997
2-9 <1999>.
2-10 SECTION 1.05. Subsection (a), Section 18.01, Texas Racing
2-11 Act (Article 179e, Vernon's Texas Civil Statutes), is amended to
2-12 read as follows:
2-13 (a) The Texas Racing Commission is subject to Chapter 325,
2-14 Government Code (Texas Sunset Act). Unless continued in existence
2-15 as provided by that chapter, and except as provided by Subsections
2-16 (b) and (c) of this section, the commission is abolished and this
2-17 Act expires September 1, 1997 <1995>.
2-18 ARTICLE 2. 1999 AGENCIES
2-19 SECTION 2.01. Subchapter B, Chapter 771, Health and Safety
2-20 Code, is amended by adding Section 771.032 to read as follows:
2-21 Sec. 771.032. APPLICATION OF SUNSET ACT. The Advisory
2-22 Commission on State Emergency Communications is subject to Chapter
2-23 325, Government Code (Texas Sunset Act). Unless continued in
2-24 existence as provided by that chapter, the advisory commission is
2-25 abolished and this chapter expires September 1, 1999.
3-1 SECTION 2.02. Subsection (a), Section 434.002, Government
3-2 Code, is amended to read as follows:
3-3 (a) The Texas Veterans Commission is subject to Chapter 325
3-4 (Texas Sunset Act). Unless continued in existence as provided by
3-5 that chapter, the commission is abolished September 1, 1999 <1997>.
3-6 SECTION 2.03. Section 161.0111, Natural Resources Code, is
3-7 amended to read as follows:
3-8 Sec. 161.0111. Sunset Provision. The Veterans' Land Board
3-9 is subject to review under Chapter 325, Government Code (Texas
3-10 Sunset Act), but is not abolished under that chapter. The board
3-11 shall be reviewed during the period in which state agencies
3-12 abolished in 1999 <1997> and every 12th year after 1999 <1997> are
3-13 reviewed.
3-14 SECTION 2.04. Section 2108.007, Government Code, is amended
3-15 to read as follows:
3-16 Sec. 2108.007. Application of Sunset Act. The Texas
3-17 Incentive and Productivity Commission is subject to Chapter 325
3-18 (Texas Sunset Act). Unless continued in existence as provided by
3-19 that chapter, the commission is abolished and this chapter expires
3-20 September 1, 1999 <2001>.
3-21 ARTICLE 3. EFFECTIVE DATE; EMERGENCY
3-22 SECTION 3.01. (a) Except as provided by Subsection (b) of
3-23 this section, this Act takes effect September 1, 1995.
3-24 (b) Section 1.05 of this Act takes effect only if the 74th
3-25 Legislature, Regular Session, 1995, does not enact other
4-1 legislation that becomes law and would amend Subsection (a),
4-2 Section 18.01, Texas Racing Act (Article 179e, Vernon's Texas Civil
4-3 Statutes), to extend the sunset date of the Texas Racing
4-4 Commission.
4-5 SECTION 3.02. The importance of this legislation and the
4-6 crowded condition of the calendars in both houses create an
4-7 emergency and an imperative public necessity that the
4-8 constitutional rule requiring bills to be read on three several
4-9 days in each house be suspended, and this rule is hereby suspended.
