                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to municipal solid waste disposal fees.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 361.013, Health and Safety Code, is
    1-4  amended by adding Subsection (h) to read as follows:
    1-5        (h)  The commission may not charge a fee under Subsection (a)
    1-6  whenever the disposal facility has donated the cost of disposal of
    1-7  solid waste to a municipality, county, or other political
    1-8  subdivision of this state in connection with solid waste resulting
    1-9  from a public entity's effort to protect the public health and
   1-10  safety of the community from the effects of a natural or man-made
   1-11  disaster or of structures which have been contributing to drug
   1-12  trafficking or other crimes.
   1-13        SECTION 2.  This Act takes effect September 1, 1995.
   1-14        SECTION 3.  The importance of this legislation and the
   1-15  crowded condition of the calendars in both houses create an
   1-16  emergency and an imperative public necessity that the
   1-17  constitutional rule requiring bills to be read on three several
   1-18  days in each house be suspended, and this rule is hereby suspended.
