No. 376 1-2 (In the Senate - Filed April 11, 1995; April 11, 1995, read 1-3 first time and referred to Committee on Natural Resources; 1-4 April 28, 1995, reported favorably by the following vote: Yeas 8, 1-5 Nays 0; April 28, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to municipal solid waste disposal fees. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 361.013, Health and Safety Code, is 1-11 amended by adding Subsection (h) to read as follows: 1-12 (h) The commission may not charge a fee under Subsection (a) 1-13 whenever the disposal facility has donated the cost of disposal of 1-14 solid waste to a municipality, county, or other political 1-15 subdivision of this state in connection with solid waste resulting 1-16 from a public entity's effort to protect the public health and 1-17 safety of the community from the effects of a natural or man-made 1-18 disaster or of structures which have been contributing to drug 1-19 trafficking or other crimes. 1-20 SECTION 2. This Act takes effect September 1, 1995. 1-21 SECTION 3. The importance of this legislation and the 1-22 crowded condition of the calendars in both houses create an 1-23 emergency and an imperative public necessity that the 1-24 constitutional rule requiring bills to be read on three several 1-25 days in each house be suspended, and this rule is hereby suspended. 1-26 * * * * *
