By: Ratliff S.B. No. 397 A BILL TO BE ENTITLED AN ACT 1-1 relating to service areas of community college districts. 1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-3 SECTION 1. Chapter 130, Education Code, is amended by adding 1-4 Subchapter J to read as follows: 1-5 SUBCHAPTER J: COMMUNITY COLLEGE DISTRICT SERVICE AREAS 1-6 Sec. 130.161. DEFINITIONS. In this section: 1-7 (1) "Board" means the Texas Higher Education 1-8 Coordinating Board. 1-9 (2) "Community college district" or "district" has the 1-10 meaning assigned by Sections 130.0011 and 130.003 of this code; 1-11 (3) "Institution of higher education" has the meaning 1-12 assigned by Section 61.003 of this code. 1-13 (4) "Service" or "services" means prebacculaureate 1-14 lower division academic education, workforce education, and 1-15 workforce training and services. 1-16 (5) "Service area" means: 1-17 (A) the territory within the boundaries of the 1-18 community college taxing district; and 1-19 (B) the territory outside the boundaries of the 1-20 community college taxing district in which the community college 1-21 district is recognized in this Act as the provider of first 1-22 responsibility to furnish academic and workforce education and 1-23 training services in accordance with the purposes stated by Section 2-1 130.003 of this code. 2-2 (6) "Workforce education" has the meaning assigned by 2-3 Section 1.04(5), Article 5190.7a, Revised Statutes. 2-4 (7) "Workforce training and services" has the meaning 2-5 assigned by Section 1.04(6), Article 5190.7a, Revised Statutes. 2-6 Sec. 130.162. RECOGNITION OF SERVICE AREAS. (a) Except as 2-7 otherwise provided by this section, each community college district 2-8 shall have a recognized service area as established by this 2-9 subchapter. 2-10 (b) The service area of one community college district shall 2-11 not extend into the service area of another community college 2-12 district, except that a community college district may by 2-13 memorandum of understanding allow another community college 2-14 district to provide services within its recognized service area, 2-15 especially if another community college district has existing 2-16 approvals or agreements for those services. 2-17 (c) To the extent that more than one institution of higher 2-18 education provides services within a county pursuant to Board 2-19 approval under Section 61.051(j) of this code, the services shall 2-20 remain subject to Section 61.051(j). 2-21 Sec. 130.163. ALAMO COMMUNITY COLLEGE DISTRICT SERVICE AREA. 2-22 The service area of Alamo Community College District includes all 2-23 of the territory within the boundaries of Bexar County, including 2-24 but not limited to the territory within the boundaries of the 2-25 following independent school districts: Alamo Heights, Harlandale, 3-1 Edgewood, Randolph, San Antonio, South San Antonio, Judson, Fort 3-2 Sam Houston, Somerset, Northeast, East Central, South West, 3-3 Lackland, Northside, and Southside. The service area also 3-4 includes: 3-5 (1) the territory within the boundaries of Atascosa 3-6 County, including the territory within the boundaries of the 3-7 Charlotte Independent School District, Jourdanton Independent 3-8 School District, Poteet Independent School District, and Lytle 3-9 Independent School District (excluding Pleasanton Independent 3-10 School District); 3-11 (2) all of the territory within the boundaries of 3-12 Bandera County, including but not limited to the territory within 3-13 the boundaries of the Bandera Independent School District and 3-14 Medina Independent School District; 3-15 (3) all of the territory within the boundaries of 3-16 Comal County, including but not limited to the territory within the 3-17 boundaries of the New Braunfels Independent School District and 3-18 Comal Independent School District; 3-19 (4) all of the territory within the boundaries of 3-20 Guadalupe County, including but not limited to the territory within 3-21 the Seguin Independent School District, Navarro Independent School 3-22 District, Marion Independent School District, and Schertz - Cibolo 3-23 - Universal City Independent School District; 3-24 (5) all of the territory within the boundaries of 3-25 Kendall County, including but not limited to the territory within 4-1 the Boerne Independent School District; 4-2 (6) all of the territory within the boundaries of Kerr 4-3 County, including but not limited to the territory within the 4-4 Center Point Independent School District, Kerrville Independent 4-5 School District, Divide Independent School District, Hunt 4-6 Independent School District, and Ingram Independent School 4-7 District; and 4-8 (7) all of the territory within the boundaries of 4-9 Wilson County, including but not limited to the territory within 4-10 the Floresville Independent School District, La Vernia Independent 4-11 School District, Poth Independent School District, and Stockdale 4-12 Independent School District. 4-13 Sec. 130.164. ALVIN COMMUNITY COLLEGE DISTRICT SERVICE AREA. 4-14 The service area of Alvin Community College District includes all 4-15 of the territory contained within the following political 4-16 subdivisions of the state: Danbury Independent School District, 4-17 Pearland Independent School District, and only the portion of 4-18 Angeleton Independent School District annexed by official vote 4-19 prior to the passage of this legislation. 4-20 Sec. 130.165. AMARILLO JUNIOR COLLEGE DISTRICT SERVICE AREA. 4-21 The service area of Amarillo Junior College District includes the 4-22 territory contained within the city limits of the City of Amarillo 4-23 and territory within the boundaries of Potter and Randall counties 4-24 that is within the taxing district of the college and outside of 4-25 the city limits of the City of Amarillo. The service area also 5-1 includes: 5-2 (1) all of the territory within the boundaries of 5-3 Potter, Randall, Carson, Oldham, Deaf Smith, Parmer, Castro and 5-4 Swisher counties; and 5-5 (2) the territory within Moore County that is within 5-6 the boundaries of the Dumas Independent School District. 5-7 Sec. 130.166. ANGELINA COUNTY JUNIOR COLLEGE DISTRICT 5-8 SERVICE AREA. The service area of Angelina County Junior College 5-9 District includes all of the territory contained within Angelina 5-10 County. The service area also includes: 5-11 (1) all of the territory within the boundaries of 5-12 Houston, Nacogdoches, Polk, Sabine, San Augustine, Trinity, and 5-13 Tyler counties; 5-14 (2) the territory within the boundaries of the Wells 5-15 Independent School District and Alto Independent School District, 5-16 located in Cherokee County; 5-17 (3) the territory within the boundaries of the 5-18 Burkeville Independent School District and Newton Independent 5-19 School District, located in Newton County; 5-20 (4) the territory within the boundaries of the Jasper 5-21 Independent School District, located in Jasper County; and 5-22 (5) the territory within the boundaries of Shepard and 5-23 Coldspring-Oakhurst Independent School Districts located within San 5-24 Jacinto County. 5-25 Sec. 130.167. AUSTIN COMMUNITY COLLEGE DISTRICT SERVICE 6-1 AREA. The service area of the Austin Community College District 6-2 includes all the territory contained within the boundaries of the 6-3 Austin Independent School District, which is located in Travis 6-4 County, and the Leander Independent School District, which is 6-5 located in Williamson and Travis counties. The service area also 6-6 includes: 6-7 (1) the territory within the boundaries of Bastrop 6-8 County; 6-9 (2) the territory within the boundaries of the Marble 6-10 Falls Independent School District, located in Burnet County; 6-11 (3) the territory within the boundaries of Hays 6-12 County; 6-13 (4) the territory within the boundaries of Gillespie 6-14 County; and 6-15 (5) the territory within Williamson County except the 6-16 territory within the boundaries of the Florence Independent School 6-17 District, Taylor Independent School District, and Granger 6-18 Independent School District; 6-19 (6) the territory within the boundaries of Caldwell 6-20 County; 6-21 (7) the territory within the boundaries of Blanco 6-22 County; and 6-23 (8) the territory within the boundaries of Travis 6-24 County that is outside of the boundaries of the Austin Independent 6-25 School District and Leander Independent School District. 7-1 Sec. 130.168. BEE COUNTY JUNIOR COLLEGE DISTRICT SERVICE 7-2 AREA. The service area of Bee County Junior College District 7-3 includes all of the territory contained within the boundaries of 7-4 Bee County. The service area also includes: 7-5 (1) the territory contained within the boundaries of 7-6 Karnes, Live Oak, Jim Wells, McMullen, Duval and Brooks counties; 7-7 (2) the territory within the boundaries of the 7-8 Pleasanton Independent School District, located in Atascosa County; 7-9 and 7-10 (3) the territory within the boundaries of the 7-11 Kingsville Independent School District, Santa Gertrudis Independent 7-12 School District, and Ricardo Independent School District, located 7-13 in Kleberg County. 7-14 Sec. 130.169. BLINN COLLEGE DISTRICT SERVICE AREA. The 7-15 service area of Blinn College District includes all of the 7-16 territory contained within the boundaries of Washington County. 7-17 The service area also includes: 7-18 (1) the territory contained within the boundaries of 7-19 Burleson County, Brazos County, Madison County, Grimes County, 7-20 Waller County, Lee County, and Fayette County; 7-21 (2) the territory within the boundaries of the Mumford 7-22 Independent School District, Hearne Independent School District, 7-23 and Franklin Independent School District located in Robertson 7-24 County; and 7-25 (3) the territory within the boundaries of the 8-1 Bellville Independent School District located in Austin County. 8-2 Sec. 130.170. BORGER JUNIOR COLLEGE DISTRICT SERVICE AREA. 8-3 The service area of Borger Junior College District includes the 8-4 territory contained within the Borger Independent School District 8-5 and, to the extent of the boundaries of the district's taxing 8-6 district, the territory within the Spring Creek Independent School 8-7 District. The service area also includes: 8-8 (1) the territory within the boundaries of Dallam, 8-9 Sherman, Hansford, Ochiltree, Lipscomb, Hartley, Hutchinson, 8-10 Roberts, and Hemphill Counties; 8-11 (2) the territory within the boundaries of Moore 8-12 County, except the territory within Dumas Independent School 8-13 District; and 8-14 (3) the territory within the Pampa Independent School 8-15 District located in Gray County. 8-16 Sec. 130.171. BRAZOSPORT COLLEGE DISTRICT SERVICE AREA. The 8-17 service area of Brazosport College District includes all the 8-18 territory contained within the boundaries of the Brazosport 8-19 Independent School District. The service area also includes: 8-20 (1) the territory within the boundaries of the 8-21 Columbia-Brazoria Independent School District, Sweeny Independent 8-22 School District, Damon Independent School District, and all of the 8-23 Angleton Independent School District except that portion which was 8-24 annexed by the Alvin Community College District prior to the 8-25 effective date of this subchapter. 9-1 Sec. 130.172. CENTRAL TEXAS COLLEGE DISTRICT SERVICE AREA. 9-2 The service area of Central Texas College District includes all the 9-3 territory contained within the boundaries of the Killeen 9-4 Independent School District, located in Bell County, and the 9-5 Copperas Cove Independent School District, located in Coryell 9-6 County. The service area also includes: 9-7 (1) the territory within the boundaries of Ft. Hood 9-8 and North Ft. Hood, located in Bell County; 9-9 (2) the territory located within the boundaries of 9-10 Coryell, Hamilton, Lampasas, Llano, Mason, Mills, and San Saba 9-11 Counties; 9-12 (3) the territory within the boundaries of the Brady 9-13 Independent School District, Lohn Independent School District, and 9-14 Rochelle Independent School District located in McCullough County; 9-15 (4) the territory within the boundaries of the Burnet 9-16 Independent School District located in Burnet County; and 9-17 (5) the territory within the Florence Independent 9-18 School District located in Williamson County. 9-19 Sec. 130.173. CISCO JUNIOR COLLEGE DISTRICT SERVICE AREA. 9-20 The service area of the Cisco Junior College District includes the 9-21 territory within the boundaries of the Cisco Independent School 9-22 District. The service area also includes all of the territory 9-23 contained within the boundaries of Callahan, Coleman, and Taylor 9-24 counties. 9-25 Sec. 130.174. CLARENDON COLLEGE DISTRICT SERVICE AREA. The 10-1 service area of Clarendon College District includes all of the 10-2 territory contained within the boundaries of Donley, Gray (except 10-3 the Pampa Independent School District), Wheeler, Armstrong, 10-4 Collingsworth, Briscoe, Hall, and Childress counties. 10-5 Sec. 130.175. COLLEGE OF THE MAINLAND DISTRICT. The service 10-6 area of the College of the Mainland District includes all of the 10-7 territory within the boundaries of the Santa Fe Independent School 10-8 District, Hitchcock Independent School District, Texas City 10-9 Independent School District, La Marque Independent School District, 10-10 Dickinson Independent School District, Friendswood Independent 10-11 School District, and the part of the Clear Creek Independent School 10-12 District that is located within Galveston County. 10-13 Sec. 130.176. COLLIN COUNTY COMMUNITY COLLEGE DISTRICT 10-14 SERVICE AREA. The service area of Collin County Community College 10-15 District includes all the territory contained within the boundaries 10-16 of Collin County and Rockwall County. The service area also 10-17 includes: 10-18 (1) territory located in Denton County, to the extent 10-19 of the boundaries of the City of The Colony, City of Frisco, Celina 10-20 Independent School District, and the Prosper Independent School 10-21 District. 10-22 Sec. 130.177. DALLAS COUNTY COMMUNITY COLLEGE DISTRICT 10-23 SERVICE AREA. The service area of Dallas County Community College 10-24 District includes all the territory contained within the boundaries 10-25 of Dallas County. The service area also includes: 11-1 (1) the territory within the boundaries of the 11-2 Carrollton Independent School District. 11-3 Sec. 130.178. DEL MAR COLLEGE - CORPUS CHRISTI JUNIOR 11-4 COLLEGE DISTRICT SERVICE AREA. The service area of Del Mar College 11-5 - Corpus Christi Junior College District includes all the territory 11-6 contained within the boundaries of the Corpus Christi Independent 11-7 School District, West Oso Independent School District, Calallen 11-8 Independent School District, Tuloso-Midway Independent School 11-9 District, Flour Bluff Independent School District, and any area 11-10 located outside of these school districts which is within the city 11-11 limits of Corpus Christi. The service area also includes: 11-12 (1) the territory contained within the boundaries of 11-13 Nueces County, San Patricio County, Aransas County, Kenedy County 11-14 and Riviera Independent School District. 11-15 Sec. 130.179. EL PASO COUNTY COMMUNITY COLLEGE DISTRICT 11-16 SERVICE AREA. The service area of El Paso County Community College 11-17 District includes all the territory contained within the boundaries 11-18 of El Paso County. The service area also includes: 11-19 (1) the territory within the boundaries of Hudspeth 11-20 County. 11-21 Sec. 130.180. GALVESTON COLLEGE DISTRICT SERVICE AREA. The 11-22 service area of Galveston College District includes all the 11-23 territory contained within the boundaries of the Galveston 11-24 Independent School District. The service area also includes: 11-25 (1) the area along the Bolivar Peninsula to the 12-1 Jefferson County line, including the City of High Island and the 12-2 High Island Independent School District; and 12-3 (2) the Sabine Pass Independent School District and 12-4 Hamshire-Pannett Independent School District in Jefferson County. 12-5 Sec. 130.181. GRAYSON COUNTY JUNIOR COLLEGE DISTRICT SERVICE 12-6 AREA. The service area of Grayson County Junior College District 12-7 includes all the territory contained within the boundaries of 12-8 Grayson County. The service area also includes: 12-9 (1) the territory within the boundaries of Bonham 12-10 Independent School District, Dodd City Independent School District, 12-11 Ector Independent School District, Leonard Independent School 12-12 District, Savoy Independent School District, Trenton Independent 12-13 School District, and Sam Rayburn Independent School District. 12-14 Sec. 130.182. HILL COLLEGE DISTRICT SERVICE AREA. The 12-15 service area of Hill College District includes all the territory 12-16 contained within the boundaries of Hillsboro Independent School 12-17 District, Itasca Independent School District, Covington Independent 12-18 School District, Whitney Independent School District, Abbott 12-19 Independent School District, and Bynum Independent School District. 12-20 The service area also includes: 12-21 (1) the territory contained within the boundaries of 12-22 Hill, Johnson, Bosque, and Somervell Counties. 12-23 Sec. 130.183. HOUSTON COMMUNITY COLLEGE SYSTEM DISTRICT 12-24 SERVICE AREA. The service area of Houston Community College System 12-25 District includes all the territory contained within the boundaries 13-1 of the Houston Independent School District and the Stafford 13-2 Independent School District. The service area also includes: 13-3 (1) the territory contained within the boundaries of 13-4 the Alief Independent School District, Katy Independent School 13-5 District, Spring Branch Independent School District, and North 13-6 Forest Independent School District. 13-7 Sec. 130.184. HOWARD COUNTY JUNIOR COLLEGE DISTRICT SERVICE 13-8 AREA. The service area of Howard County Junior College District 13-9 includes all the territory contained within the boundaries of 13-10 Howard County. The service area also includes: 13-11 (1) the territory contained within the boundaries of 13-12 the following counties: Dawson, Martin, Glasscock, Sterling, Coke, 13-13 Tom Green, Concho, Irion, Schleicher, Sutton, Menard, and Kimble. 13-14 Sec. 130.185. KILGORE JUNIOR COLLEGE DISTRICT SERVICE AREA. 13-15 The service area of Kilgore Junior College District includes all 13-16 the territory contained within the boundaries of the Kilgore 13-17 Independent School District, West Rusk Independent School District, 13-18 Overton Independent School District, Leverett's Chapel Independent 13-19 School District, White Oak Independent School District, Sabine 13-20 Independent School District, and Gladewater Independent School 13-21 Districts. The service area also includes: 13-22 (1) the territory contained within the following 13-23 independent school districts: Big Sandy, Union Grove, Gilmer, New 13-24 Diana, Spring Hill, Pine Tree, Longview, Hallsville, Tatum, 13-25 Henderson, Carlisle, Laneville, and Mount Enterprise. 14-1 Sec. 130.186. LAREDO COMMUNITY COLLEGE DISTRICT SERVICE 14-2 AREA. The service area of Laredo Community College District 14-3 includes all the territory contained within the boundaries of the 14-4 city limits of the City of Laredo. The service area also includes: 14-5 (1) all the territory contained within the boundaries 14-6 of Webb, Jim Hogg, and Zapata counties. 14-7 Sec. 130.187. LEE COLLEGE DISTRICT SERVICE AREA. The 14-8 service area of Lee College District includes all the territory 14-9 contained within the boundaries of the Goose Creek Consolidated 14-10 Independent School District. The service area also includes: 14-11 (1) the territory within the boundaries of the 14-12 following independent school districts: Crosby, Dayton, Liberty, 14-13 Barbers Hill, Anahuac, Huffman, Devers, East Chambers, Hardin, and 14-14 Hull-Daisetta. 14-15 Sec. 130.188. MCLENNAN COMMUNITY COLLEGE DISTRICT SERVICE 14-16 AREA. The service area of McLennan Community College District 14-17 includes all the territory contained within the boundaries of 14-18 McLennan County. The service area also includes: 14-19 (1) the territory contained within the boundaries of 14-20 Falls County; and 14-21 (2) the territory contained within the boundaries of 14-22 the Calvert Independent School District and Bremond Independent 14-23 School District. 14-24 Sec. 130.189. MIDLAND COMMUNITY COLLEGE DISTRICT SERVICE 14-25 AREA. The service area of Midland Community College District 15-1 includes all the territory contained within the boundaries of 15-2 Midland County, with the exception of the Greenwood Community. The 15-3 service area also includes: 15-4 (1) the territory contained within the boundaries of 15-5 Reagan and Crockett counties; 15-6 (2) the territory within the city limits of the City 15-7 of Ft. Stockton; and 15-8 (3) the territory within the city limits of the City 15-9 of Iraan in Pecos County. 15-10 Sec. 130.190. NAVARRO COLLEGE DISTRICT SERVICE AREA. The 15-11 service area of Navarro College District includes all the territory 15-12 contained within the boundaries of Navarro County. The service 15-13 area also includes: 15-14 (1) the territory contained within the boundaries of 15-15 Ellis, Freestone, Limestone, and Leon counties. 15-16 Sec. 130.191. NORTH CENTRAL TEXAS COLLEGE DISTRICT SERVICE 15-17 AREA. The service area of North Central Texas College District 15-18 includes all the territory contained within the boundaries of the 15-19 territory of Cooke County. The service area also includes: 15-20 (1) the territory contained within the boundaries of 15-21 Cooke and Montague counties; and 15-22 (2) the territory contained within the boundaries of 15-23 Denton County, with the exception of: 15-24 (A) the territory within the municipal 15-25 boundaries of The Colony and the City of Frisco; 16-1 (B) the territory within the boundaries of the 16-2 Celina, Prosper, and Carrollton Independent School Districts. 16-3 Sec. 130.192. NORTH HARRIS MONTGOMERY COMMUNITY COLLEGE 16-4 DISTRICT SERVICE AREA. The service area of North Harris Montgomery 16-5 Community College District includes all the territory contained 16-6 within the boundaries of the Aldine Independent School District, 16-7 Conroe Independent School District, Humble Independent School 16-8 District, New Caney Independent School District, Spring Independent 16-9 School District, and Tomball Independent School District. The 16-10 service area also includes: 16-11 (1) the territory contained within the boundaries of 16-12 the following independent school districts: Magnolia, Willis, 16-13 Montgomery, Splendora, Cleveland, Tarkington, and Klein; and 16-14 (2) the territory contained within the boundaries of 16-15 the Huntsville Independent School District and New Waverly 16-16 Independent School District in Walker County. 16-17 Sec. 130.193. NORTHEAST TEXAS COMMUNITY COLLEGE DISTRICT 16-18 SERVICE AREA. The service area of Northeast Texas Community 16-19 College District includes all the territory contained within the 16-20 boundaries of Camp County, Morris County, and Titus County. The 16-21 service area also includes: 16-22 (1) the territory contained within the boundaries of 16-23 Avinger Independent School District and Hughes Spring Independent 16-24 School District, located in Cass County; 16-25 (2) the territory contained within the boundaries of 17-1 the Mt. Vernon Independent School District, located in Franklin 17-2 County; 17-3 (3) the territory contained within the boundaries of 17-4 the Como Pickton Independent School District and Saltillo 17-5 Independent School District, located in Hopkins County; 17-6 (4) the territory contained within the boundaries of 17-7 the Ore City Independent School District, Union Hill Independent 17-8 School District, and Harmony Independent School District, located 17-9 in Upshur County; and 17-10 (5) the territory contained with the boundaries of the 17-11 Winnsboro Independent School District, located in Wood County. 17-12 Sec. 130.194. ODESSA COLLEGE DISTRICT SERVICE AREA. The 17-13 service area of Odessa College District includes all the territory 17-14 contained within the boundaries of the following counties: 17-15 Brewster, Andrews, Crane, Jeff Davis, Ward, Winkler, Presidio, 17-16 Upton, Reeves, Culberson, Loving, and Terrell Counties. The 17-17 service area also includes: 17-18 (1) the territory within the city limits of the City 17-19 of Coyanosa and the City of Imperial, located in Pecos County; and 17-20 (2) the territory within the Seminole Independent 17-21 School District in Gaines County. 17-22 Sec. 130.195. PANOLA COLLEGE DISTRICT SERVICE AREA. The 17-23 service area of Panola College District includes all the territory 17-24 contained within the boundaries of Panola County. The service area 17-25 also includes: 18-1 (1) the territory contained within the boundaries of 18-2 Marion and Shelby counties; and 18-3 (2) the territory contained within Harrison County, 18-4 with the exception of the Hallsville Independent School District. 18-5 Sec. 130.196. PARIS JUNIOR COLLEGE DISTRICT SERVICE AREA. 18-6 The service area of Paris Junior College District includes all of 18-7 the Paris Independent School District, the part of the Prairiland 18-8 Independent School District that was formerly the Cunningham School 18-9 District, and the territory within the city limits of the City of 18-10 Paris. The service area also includes: 18-11 (1) all of the territory of Lamar County, Delta 18-12 County, Hunt County, the Detroit Independent School District, 18-13 Clarksville Independent School District, Talco-Bogata Consolidated 18-14 Independent School District that is in Red River County, North 18-15 Hopkins Independent School District, Sulphur Bluff Independent 18-16 School District, Sulphur Springs Independent School District, 18-17 Miller Grove Independent School District and the Cumby Independent 18-18 School District in Hopkins County; and 18-19 (2) Honey Grove Consolidated Independent School 18-20 District in Fannin County and the Fannindel Independent School 18-21 District, located in Fannin and Delta counties. 18-22 Sec. 130.197. RANGER JUNIOR COLLEGE DISTRICT SERVICE AREA. 18-23 The service area of Ranger Junior College District includes the 18-24 territory contained within the boundaries of the Ranger Independent 18-25 School District, to the extent that such territory is located 19-1 within Eastland County, with the exception of the area that is 19-2 known as the old Bullock School Land. The service area also 19-3 includes: 19-4 (1) the territory contained within the boundaries of 19-5 the following counties: Young, Comanche, Brown, and Erath. 19-6 Sec. 130.198. SAN JACINTO COLLEGE DISTRICT SERVICE AREA. 19-7 The service area of San Jacinto College District includes all the 19-8 territory contained within the boundaries of the following 19-9 independent school districts: Pasadena, La Porte, Deer Park, 19-10 Channelview, Galena Park, and Sheldon. The service area also 19-11 includes: 19-12 (1) the portion of Clear Creek Independent School 19-13 District which is located in Harris County. 19-14 Sec. 130.199. SOUTH PLAINS JUNIOR COLLEGE DISTRICT SERVICE 19-15 AREA. The service area of South Plains Junior College District 19-16 includes all the territory contained within the boundaries of 19-17 Hockley County and the Whiteface Independent School District. The 19-18 service area also includes: 19-19 (1) the territory contained within the boundaries of 19-20 the following counties: Bailey, Lamb, Hale, Floyd, Motley, 19-21 Cochran, Hockley, Lubbock, Crosby, Yoakum, Terry, Lynn, Garza, and; 19-22 (3) the territory within the boundaries of Gaines 19-23 County, excluding the Seminole Independent School District. 19-24 Sec. 130.200. SOUTH TEXAS COMMUNITY COLLEGE DISTRICT SERVICE 19-25 AREA. The service area of South Texas Community College District 20-1 includes all the territory contained within the boundaries of 20-2 Hidalgo and Starr Counties. 20-3 Sec. 130.201. SOUTHWEST TEXAS JUNIOR COLLEGE DISTRICT 20-4 SERVICE AREA. The service area of Southwest Texas Junior College 20-5 District includes all the territory contained within the boundaries 20-6 of Zavala and Uvalde Counties, and that portion of Real County that 20-7 is within the taxing district. The service area also includes: 20-8 (1) the territory contained within the boundaries of 20-9 the following counties: Dimmit, Frio, Kinney, La Salle, Maverick, 20-10 Medina, Real, Uvalde, Val Verde, Zavala, and Edwards. 20-11 Sec. 130.202. TARRANT COUNTY JUNIOR COLLEGE DISTRICT SERVICE 20-12 AREA. The service area of Tarrant County Junior College District 20-13 includes all the territory contained within the boundaries of 20-14 Tarrant County. 20-15 Sec. 130.203. TEMPLE JUNIOR COLLEGE DISTRICT SERVICE AREA. 20-16 The service area of Temple Junior College District includes all the 20-17 territory contained within the boundaries of the Temple Independent 20-18 School District and the City of Temple. The service area also 20-19 includes: 20-20 (1) the territory contained within the boundaries of 20-21 the following independent school districts located in Bell 20-22 County: Academy, Bartlett, Belton, Holland, Rogers, Troy, and 20-23 Salado; 20-24 (2) the territory contained within the boundaries of 20-25 the following independent school districts located in Milam 21-1 County: Buckholts, Cameron, Milano, Rockdale, and Thorndale; and 21-2 (3) the territory contained within the boundaries of 21-3 the following independent school districts located in Williamson 21-4 County: Granger and Taylor. 21-5 Sec. 130.204. TEXARKANA COLLEGE DISTRICT SERVICE AREA. The 21-6 service area of Texarkana College District includes the territory 21-7 contained within the boundaries of the taxing district, which 21-8 includes part of the City of Texarkana and a portion of the 21-9 Pleasant Grove Independent School District. The service area also 21-10 includes: 21-11 (1) all of the territory within the boundaries of 21-12 Bowie County; 21-13 (2) all of the territory within the boundaries of Cass 21-14 County except for the territory within the boundaries of the Hughes 21-15 Springs Independent School District, Avinger Independent School 21-16 District, and Paul Pewitt Independent School District; and 21-17 (3) the territory within the boundaries of the Avery 21-18 Independent School District located in Red River County. 21-19 Sec. 130.205. TEXAS SOUTHMOST COLLEGE DISTRICT SERVICE AREA. 21-20 The service area of Texas Southmost College District includes all 21-21 the territory contained within the boundaries of the following 21-22 independent school districts: Brownsville, Los Fresnos, and Point 21-23 Isabel. The service area also includes: 21-24 (1) the territory within the boundaries of Cameron 21-25 County. 22-1 Sec. 130.206. TRINITY VALLEY COMMUNITY COLLEGE DISTRICT 22-2 SERVICE AREA. The service area of Trinity Valley Community College 22-3 District includes the territory contained within the boundaries of 22-4 Henderson County; Kaufman County, except the Forney Independent 22-5 School District and the Wills Point Independent School District; 22-6 that portion of the Terrell Independent School District located in 22-7 Hunt County; that portion of the Mabank Independent School District 22-8 located in Van Zandt County; that portion of the LaPoyner 22-9 Independent School District and the Frankston Independent School 22-10 District located in Anderson County; and the Palestine Independent 22-11 School District, located in Anderson County. The service area also 22-12 includes: 22-13 (1) the territory contained within the boundaries of 22-14 Anderson, Henderson, Kaufman, and Rains Counties; and 22-15 (2) the territory contained within the boundaries of 22-16 Van Zandt County, except the Grand Saline Independent School 22-17 District and the Van Independent School District. 22-18 Sec. 130.207. TYLER JUNIOR COLLEGE DISTRICT SERVICE AREA. 22-19 The service area of Tyler Junior College District includes all the 22-20 territory contained within the boundaries of the following 22-21 independent school districts: Chapel Hill, Grand Saline, Lindale, 22-22 Tyler, Van, and Winona. The service area also includes: 22-23 (1) the territory contained within the boundaries of 22-24 the following independent school districts: Alba-Golden, Arp, 22-25 Bullard, Hawkins, Jacksonville, Mineola, New Summerfield, Quitman, 23-1 Rusk, Troup, and Whitehouse. 23-2 Sec. 130.208. VERNON REGIONAL JUNIOR COLLEGE DISTRICT 23-3 SERVICE AREA. The service area of Vernon Regional Junior College 23-4 District includes all the territory contained within the boundaries 23-5 of Wilbarger County. The service area also includes: 23-6 (1) the territory within the boundaries of the 23-7 following counties: Archer, Baylor, Clay, Cottle, Foard, Hardeman, 23-8 Haskell, King, Knox, Throckmorton, and Wichita. 23-9 Sec. 130.209. VICTORIA COLLEGE DISTRICT SERVICE AREA. The 23-10 service area of Victoria College District includes all the 23-11 territory contained within the boundaries of Victoria County. The 23-12 service area also includes: 23-13 (1) all of the territory contained within the 23-14 boundaries of Gonzales, Lavaca, Dewitt, and Calhoun counties; 23-15 (2) the territory within the boundaries of Jackson 23-16 County, except for the territory within the boundaries of the 23-17 Ganado Independent School District; and 23-18 (3) the territory within the boundaries of Refugio 23-19 County, except for the territory within the boundaries of the 23-20 Woodsboro Independent School District. 23-21 Sec. 130.210. WEATHERFORD COLLEGE DISTRICT SERVICE AREA. 23-22 The service area of Weatherford College District includes all the 23-23 territory contained within the boundaries of Parker County. The 23-24 service area also includes: 23-25 (1) the territory contained within the boundaries of 24-1 Wise, Jack, and Palo Pinto counties. 24-2 Sec. 130.211. WESTERN TEXAS COLLEGE DISTRICT SERVICE AREA. 24-3 The service area of Western Texas College District includes all the 24-4 territory contained within the boundaries of Scurry County. The 24-5 service area also includes: 24-6 (1) the territory contained within the boundaries of 24-7 the following counties: Fisher, Jones, Nolan, Runnels, Dickens, 24-8 Stonewall, Borden, Mitchell, and Kent. 24-9 Sec. 130.212. WHARTON COUNTY JUNIOR COLLEGE DISTRICT SERVICE 24-10 AREA. The service area of Wharton County Junior College District 24-11 includes all the territory contained within the boundaries of 24-12 Wharton County and the Needville Independent School District in 24-13 Fort Bend County. The service area also includes: 24-14 (1) the territory contained within the boundaries of 24-15 the following independent school districts located in Austin 24-16 County: Wallis-Orchard; 24-17 (2) the territory contained within the following 24-18 independent school districts located in Colorado County: Columbus, 24-19 Rice Consolidated, and Weimer; 24-20 (3) the territory contained within the following 24-21 independent school districts located in Fort Bend 24-22 County: Kendleton and Lamar; 24-23 (4) the territory contained within the following 24-24 independent school districts located in Matagorda County: Bay 24-25 City, Matagorda, Palacios, Tidehaven, and Van Vleck; and 25-1 (5) the territory contained within the following 25-2 independent school districts located in Jackson County: Ganado 25-3 ISD. 25-4 Sec. 130.213. RECOGNITION OF SERVICE AREAS BY THE 25-5 COORDINATING BOARD. (a) If this subchapter does not establish a 25-6 service area for a particular junior college district, the Board 25-7 may establish a service area for the district. 25-8 (b) Territory may be included within the service area of a 25-9 community college district under this section only if: 25-10 (1) the community college district's board of trustees 25-11 recognizes the territory as part of the district's service area; 25-12 (2) the Board approves the inclusion of the territory 25-13 within the district's service area; and 25-14 (3) the inclusion of the territory within the 25-15 district's service area is not contested by another community 25-16 college district prior to September 1, 1995. 25-17 Sec. 130.214. PROVISION OF SERVICES. (a) A community 25-18 college district is obligated within available local funds and 25-19 state appropriations to deliver prebacculaureate lower division 25-20 academic education, workforce education and workforce training and 25-21 services to the residents and employers of its service area in 25-22 accordance with: 25-23 (1) the purposes prescribed by Sections 130.011 and 25-24 130.003 of this code, and the applicable program approval rules and 25-25 appropriations formulas adopted by the Board pursuant thereto; and 26-1 (2) the strategic plan developed by the Council on 26-2 Workforce and Economic Competitiveness pursuant to Section 26-3 2.06(a)(6), Article 5190.7a, Revised Statutes. 26-4 (b) If a community college district is unable within 26-5 available local funds and state appropriations to deliver a 26-6 particular service requested by residents or employers who reside 26-7 within the district's service area but outside of the boundaries of 26-8 the community college taxing district, the residents or employers 26-9 may request another institution of higher education to provide the 26-10 service if: 26-11 (1) the Board approves the provision of the service 26-12 pursuant to Section 61.051(j) of this code; and 26-13 (2) the residents or employers to whom the service is 26-14 provided pay the local share of the cost of providing the service. 26-15 For purposes of this section, "local share" means the difference 26-16 between the state-approved formula funding for the service 26-17 specified in the most recent Appropriations Act and the average 26-18 total cost of providing the service for community college districts 26-19 at and above the 75th percentile of districts providing the 26-20 service, according to the most recent cost study conducted by the 26-21 Board. 26-22 SECTION 2. This Act takes effect September 1, 1995. 26-23 SECTION 3. The importance of this legislation and the 26-24 crowded condition of the calendars in both houses create an 26-25 emergency and an imperative public necessity that the 27-1 constitutional rule requiring bills to be read on three several 27-2 days in each house be suspended, and this rule is hereby suspended.
