A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the distribution of the foundation school fund.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Sections 16.260(b), (c), and (d), Education Code,
1-5 are amended to read as follows:
1-6 (b) Payments from the foundation school fund to each
1-7 category 1 school district shall be made as follows:
1-8 (1) 15 <21> percent of the yearly entitlement of the
1-9 district shall be paid in an installment <two equal installments>
1-10 to be made on or before the 25th day of September <and October> of
1-11 a fiscal year;
1-12 (2) 80 <57> percent of the yearly entitlement of the
1-13 district shall be paid in eight <six> equal installments to be made
1-14 on or before the 25th day of October, November, December, January,
1-15 <February,> March, May, June, and July; and
1-16 (3) five <22> percent of the yearly entitlement of the
1-17 district shall be paid in an installment <two equal installments>
1-18 to be made on or before the 25th day of February <April and May>.
1-19 (c) Payments from the foundation school fund to each
1-20 category 2 school district shall be made as follows:
1-21 (1) 22 <21> percent of the yearly entitlement of the
1-22 district shall be paid in an installment <two equal installments>
1-23 to be made on or before the 25th day of September <and October> of
1-24 a fiscal year;
2-1 (2) 18 <38> percent of the yearly entitlement of the
2-2 district shall be paid in an installment <four equal installments>
2-3 to be made on or before the 25th day of October <November,
2-4 December, March, and July>;
2-5 (3) 9.5 <seven> percent of the yearly entitlement of
2-6 the district shall be paid in an installment <two equal
2-7 installments> to be made on or before the 25th day of November
2-8 <January and February>;
2-9 (4) 7.5 <22> percent of the yearly entitlement of the
2-10 district shall be paid in an installment <two equal installments>
2-11 to be made on or before the 25th day of April <and May>; <and>
2-12 (5) five <12> percent of the yearly entitlement of the
2-13 district shall be paid in an installment <two equal installments>
2-14 to be made on or before the 25th day of May <June and August>;
2-15 (6) 10 percent of the yearly entitlement of the
2-16 district shall be paid in an installment to be made on or before
2-17 the 25th day of June;
2-18 (7) 13 percent of the yearly entitlement of the
2-19 district shall be paid in an installment to be made on or before
2-20 the 25th day of July; and
2-21 (8) 15 percent of the yearly entitlement of the
2-22 district shall be paid in an installment to be made on or before
2-23 the 25th day of August.
2-24 (d) Payments from the foundation school fund to each
2-25 category 3 school district shall be made as follows:
2-26 (1) 45 <21> percent of the yearly entitlement of the
2-27 district shall be paid in an installment <two equal installments>
3-1 to be made on or before the 25th day of September <and October> of
3-2 a fiscal year;
3-3 (2) 35 <57> percent of the yearly entitlement of the
3-4 district shall be paid in an installment <six equal installments>
3-5 to be made on or before the 25th day of October <November,
3-6 December, March, June, July, and August>; and
3-7 (3) 20 <22> percent of the yearly entitlement of the
3-8 district shall be paid in an installment <two equal installments>
3-9 to be made on or before the 25th day of August <April and May>.
3-10 SECTION 2. This Act takes effect September 1, 1995.
3-11 SECTION 3. The importance of this legislation and the
3-12 crowded condition of the calendars in both houses create an
3-13 emergency and an imperative public necessity that the
3-14 constitutional rule requiring bills to be read on three several
3-15 days in each house be suspended, and this rule is hereby suspended.
