                                        AN ACT
    1-1  relating to making emergency appropriations for distribution of
    1-2  state money to school districts and certain public institutions and
    1-3  commissions and to emergency reductions in the current
    1-4  appropriations to the Texas Department of Health.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  (a)  On determination pursuant to Subsection (i),
    1-7  Section 16.254, Education Code, of the actual amount of state funds
    1-8  to which each school district is entitled for the 1994-1995 school
    1-9  year and the amount of adjustment of each district's entitlement
   1-10  for the next fiscal year, those districts whose adjustment would
   1-11  result in an increase for the next fiscal year may receive payment
   1-12  of all or, on a pro rata basis, part of that increase during the
   1-13  current fiscal year, to the extent that appropriations provided by
   1-14  this section allow.
   1-15        (b)  To the extent that appropriations provided by this
   1-16  section exceed the total of increased entitlements determined
   1-17  pursuant to Subsection (i), Section 16.254, Education Code, and
   1-18  payable during the current fiscal year pursuant to Subsection (a)
   1-19  of this section, the remainder shall be paid to all school
   1-20  districts on a pro rata basis on or before July 25, 1995, as an
   1-21  advance on payments otherwise due on or before September 25, 1995.
   1-22        (c)  The sum of $305 million is appropriated from the General
   1-23  Revenue Fund to the Central Education Agency for the payments
   1-24  authorized by this section for the current fiscal year.
    2-1        SECTION 2.  (a)  In addition to amounts previously
    2-2  appropriated for the current fiscal biennium, the sum of
    2-3  $13,744,133 is appropriated from the General Revenue Fund to the
    2-4  Texas Higher Education Coordinating Board for the remainder of the
    2-5  fiscal year ending August 31, 1995, to fund enrollment and start-up
    2-6  costs at new campuses at Collin County Community College, North
    2-7  Harris Montgomery Community College, Blinn College, and Tarrant
    2-8  County Junior College.
    2-9        (b)  Unexpended and unencumbered balances of the amount
   2-10  appropriated by this section remaining at the end of fiscal year
   2-11  1995 are reappropriated for the same purposes for the fiscal
   2-12  biennium ending August 31, 1997.
   2-13        SECTION 3.  In addition to amounts previously appropriated
   2-14  for the current fiscal biennium, the sum of $2,312,050 is
   2-15  appropriated from the General Revenue Fund to the Texas Higher
   2-16  Education Coordinating Board for the remainder of the fiscal year
   2-17  ending August 31, 1995, to fund infrastructure development, student
   2-18  support services, the physical plant, and instructional costs at
   2-19  South Texas Community College.
   2-20        SECTION 4.  (a)  The appropriations out of the General
   2-21  Revenue Fund to the Texas Department of Health are reduced for the
   2-22  fiscal year ending August 31, 1995, in the aggregate amount of
   2-23  $8,250,000.  The department shall identify the strategies and
   2-24  objectives out of which the reductions are made.
   2-25        (b)  Out of that amount:
   2-26              (1)  the comptroller shall transfer to the Disaster
   2-27  Contingency Account No. 453 in the General Revenue Fund the sum of
    3-1  $4,000,000, and that amount in addition to amounts previously
    3-2  appropriated for the current fiscal biennium is appropriated for
    3-3  the remainder of the fiscal year ending August 31, 1995, to the
    3-4  governor for the purposes described by Section 418.073, Government
    3-5  Code;
    3-6              (2)  in addition to amounts previously appropriated for
    3-7  the current fiscal biennium there is appropriated for the remainder
    3-8  of the fiscal year ending August 31, 1995, to the Texas Youth
    3-9  Commission the sum of $4,000,000 for the purpose of paying for the
   3-10  confinement and care of juvenile offenders committed to the custody
   3-11  of the commission, except that the commission may not expend more
   3-12  than $2,300,000 of that amount without the prior written approval
   3-13  of the governor given after the governor has sought the advice of
   3-14  the Legislative Budget Board; and
   3-15              (3)  in addition to amounts previously appropriated for
   3-16  the current fiscal biennium there is appropriated for the remainder
   3-17  of the fiscal year ending August 31, 1995, to the Department of
   3-18  Public Safety of the State of Texas the sum of $250,000 for the
   3-19  purpose of paying for expenses associated with the commission's
   3-20  investigation of matters related to the Texas Commission on Alcohol
   3-21  and Drug Abuse, with any unencumbered and unexpended balances of
   3-22  that amount remaining at the end of the fiscal year ending August
   3-23  31, 1995, being reappropriated to the Department of Public Safety
   3-24  of the State of Texas for the same purposes for the fiscal biennium
   3-25  ending August 31, 1997.
   3-26        SECTION 5.  The importance of this legislation and the
   3-27  crowded condition of the calendars in both houses create an
    4-1  emergency and an imperative public necessity that the
    4-2  constitutional rule requiring bills to be read on three several
    4-3  days in each house be suspended, and this rule is hereby suspended,
    4-4  and that this Act take effect and be in force from and after its
    4-5  passage, and it is so enacted.
