No. 407 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to making emergency appropriations for distribution of 1-3 state money to school districts and certain public institutions and 1-4 commissions and to emergency reductions in the current 1-5 appropriations to the Texas Department of Health. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. (a) On determination pursuant to Subsection (i), 1-8 Section 16.254, Education Code, of the actual amount of state funds 1-9 to which each school district is entitled for the 1994-1995 school 1-10 year and the amount of adjustment of each district's entitlement 1-11 for the next fiscal year, those districts whose adjustment would 1-12 result in an increase for the next fiscal year may receive payment 1-13 of all or, on a pro rata basis, part of that increase during the 1-14 current fiscal year, to the extent that appropriations provided by 1-15 this section allow. 1-16 (b) To the extent that appropriations provided by this 1-17 section exceed the total of increased entitlements determined 1-18 pursuant to Subsection (i), Section 16.254, Education Code, and 1-19 payable during the current fiscal year pursuant to Subsection (a) 1-20 of this section, the remainder shall be paid to all school 1-21 districts on a pro rata basis on or before July 25, 1995, as an 1-22 advance on payments otherwise due on or before September 25, 1995. 1-23 (c) The sum of $305 million is appropriated from the general 1-24 revenue fund to the Central Education Agency for the payments 2-1 authorized by this section for the current fiscal year. 2-2 SECTION 2. (a) In addition to amounts previously 2-3 appropriated for the current fiscal biennium, the sum of 2-4 $13,744,133 is appropriated from the general revenue fund to the 2-5 Texas Higher Education Coordinating Board for the remainder of the 2-6 fiscal year ending August 31, 1995, to fund enrollment and start-up 2-7 costs at new campuses at Collin County Community College, North 2-8 Harris Montgomery Community College, Blinn College, and Tarrant 2-9 County Junior College. 2-10 (b) Unexpended and unencumbered balances of the amount 2-11 appropriated by this section remaining at the end of fiscal year 2-12 1995 are reappropriated for the same purposes for the fiscal 2-13 biennium ending August 31, 1997. 2-14 SECTION 3. In addition to amounts previously appropriated 2-15 for the current fiscal biennium, the sum of $2,312,050 is 2-16 appropriated from the general revenue fund to the Texas Higher 2-17 Education Coordinating Board for the remainder of the fiscal year 2-18 ending August 31, 1995, to fund infrastructure development, student 2-19 support services, the physical plant, and instructional costs at 2-20 South Texas Community College. 2-21 SECTION 4. (a) The appropriations out of the general 2-22 revenue fund to the Texas Department of Health are reduced for the 2-23 fiscal year ending August 31, 1995, in the aggregate amount of 2-24 $8,250,000. The department shall identify the strategies and 2-25 objectives out of which the reductions are made. 2-26 (b) Out of that amount: 2-27 (1) the comptroller shall transfer to the Disaster 3-1 Contingency Account No. 453 in the general revenue fund the sum of 3-2 $4,000,000, and that amount in addition to amounts previously 3-3 appropriated for the current fiscal biennium is appropriated for 3-4 the remainder of the fiscal year ending August 31, 1995, to the 3-5 governor for the purposes described by Section 418.073, Government 3-6 Code; 3-7 (2) in addition to amounts previously appropriated for 3-8 the current fiscal biennium there is appropriated for the remainder 3-9 of the fiscal year ending August 31, 1995, to the Texas Youth 3-10 Commission the sum of $4,000,000 for the purpose of paying for the 3-11 confinement and care of juvenile offenders committed to the custody 3-12 of the commission, except that the commission may not expend more 3-13 than $2,300,000 of that amount without the prior written approval 3-14 of the governor given after the governor has sought the advice of 3-15 the Legislative Budget Board; and 3-16 (3) in addition to amounts previously appropriated for 3-17 the current fiscal biennium there is appropriated for the remainder 3-18 of the fiscal year ending August 31, 1995, to the Department of 3-19 Public Safety the sum of $250,000 for the purpose of paying for 3-20 expenses associated with the commission's investigation of matters 3-21 related to the Texas Commission on Alcohol and Drug Abuse, with any 3-22 unencumbered and unexpended balances of that amount remaining at 3-23 the end of the fiscal year ending August 31, 1995, being 3-24 reappropriated to the Department of Public Safety for the same 3-25 purposes for the fiscal biennium ending August 31, 1997. 3-26 SECTION 5. The importance of this legislation and the 3-27 crowded condition of the calendars in both houses create an 4-1 emergency and an imperative public necessity that the 4-2 constitutional rule requiring bills to be read on three several 4-3 days in each house be suspended, and this rule is hereby suspended, 4-4 and that this Act take effect and be in force from and after its 4-5 passage, and it is so enacted.
