1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to making emergency appropriations for distribution of
1-11 state money to school districts and certain public institutions and
1-12 commissions.
1-13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14 SECTION 1. (a) On determination pursuant to Subsection (i),
1-15 Section 16.254, Education Code, of the actual amount of state funds
1-16 to which each school district is entitled for the 1994-1995 school
1-17 year and the amount of adjustment of each district's entitlement
1-18 for the next fiscal year, those districts whose adjustment would
1-19 result in an increase for the next fiscal year may receive payment
1-20 of all or, on a pro rata basis, part of that increase during the
1-21 current fiscal year, to the extent that appropriations provided by
1-22 this section allow.
1-23 (b) To the extent that appropriations provided by this
1-24 section exceed the total of increased entitlements determined
1-25 pursuant to Subsection (i), Section 16.254, Education Code, and
1-26 payable during the current fiscal year pursuant to Subsection (a)
1-27 of this section, the remainder shall be paid to all school
1-28 districts on a pro rata basis on or before July 25, 1995, as an
1-29 advance on payments otherwise due on or before September 25, 1995.
1-30 (c) The sum of $305 million is appropriated from the General
1-31 Revenue Fund to the Central Education Agency for the payments
1-32 authorized by this section for the current fiscal year.
1-33 SECTION 2. In addition to amounts previously appropriated
1-34 for the current fiscal biennium, the sum of $740,000 is
1-35 appropriated for the remainder of the fiscal year ending August 31,
1-36 1995, from the General Revenue Fund to Tarleton State University
1-37 for expenses incurred in performing repairs to the roofs of 16
1-38 educational and general use buildings which were damaged by severe
1-39 hailstorms in April and May of 1994.
1-40 SECTION 3. (a) In addition to amounts previously
1-41 appropriated for the current fiscal biennium, the sum of $1,449,405
1-42 is appropriated for the remainder of the fiscal year ending
1-43 August 31, 1995, from the General Revenue Fund to Southwest Texas
1-44 State University for the purpose of paying the costs of repair and
1-45 reconstruction of buildings and other structures damaged by
1-46 hailstorm and water.
1-47 (b) The amount appropriated by this section may be used to
1-48 reimburse Southwest Texas State University's institutional funds,
1-49 as defined by Subsection (b), Section 51.009, Education Code, for
1-50 any amount previously paid for work undertaken to repair or
1-51 reconstruct the buildings and other structures, regardless of the
1-52 fiscal year in which the payments were made.
1-53 SECTION 4. (a) The sum of $13,744,133 is appropriated from
1-54 the General Revenue Fund to the Texas Higher Education Coordinating
1-55 Board to fund enrollment and start-up costs at new campuses at
1-56 Collin County Community College, North Harris Montgomery Community
1-57 College, Blinn College, and Tarrant County Junior College.
1-58 (b) Unexpended balances of the amount appropriated by this
1-59 section remaining at the end of fiscal year 1995 are reappropriated
1-60 for the same purposes during the 1996-1997 biennium.
1-61 SECTION 5. The sum of $2,312,050 is appropriated from the
1-62 General Revenue Fund to the Texas Higher Education Coordinating
1-63 Board to fund infrastructure development, student support services,
1-64 the physical plant, and instructional costs at South Texas
1-65 Community College.
1-66 SECTION 6. In addition to amounts previously appropriated
1-67 for the current fiscal biennium, the sum of $70,000 is appropriated
1-68 for the remainder of the fiscal year ending August 31, 1995, from
2-1 the General Revenue Fund to the Texas Cosmetology Commission for
2-2 the purpose of paying the costs associated with carrying out the
2-3 provisions of Chapter 1036, Acts of the 62nd Legislature, Regular
2-4 Session, 1971 (Article 8451a, Vernon's Texas Civil Statutes).
2-5 SECTION 7. The importance of this legislation and the
2-6 crowded condition of the calendars in both houses create an
2-7 emergency and an imperative public necessity that the
2-8 constitutional rule requiring bills to be read on three several
2-9 days in each house be suspended, and this rule is hereby suspended,
2-10 and that this Act take effect and be in force from and after its
2-11 passage, and it is so enacted.
