                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the use of certain electronic banking machines at a
    1-3  pari-mutuel racetrack.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.04(c), Texas Racing Act (Article 179e,
    1-6  Vernon's Texas Civil Statutes), is amended to read as follows:
    1-7        (c)  The commission shall adopt rules prohibiting an
    1-8  association from accepting a wager made on credit and shall adopt
    1-9  rules prohibiting automatic banking machines within the enclosure.
   1-10  The commission may not prohibit an electronic checking machine
   1-11  that:
   1-12              (1)  allows a person to access only the person's
   1-13  checking account at a bank or other financial institution; and
   1-14              (2)  requires the presence of an employee of the
   1-15  financial institution or association to:
   1-16                    (A)  initiate the access to the checking account;
   1-17  and
   1-18                    (B)  complete any withdrawal from the account by
   1-19  delivering the cash withdrawn to the account holder.
   1-20        SECTION 2.  This Act takes effect September 1, 1995.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
