                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to rule-making authority under the state's program to
    1-3  assist historically underutilized businesses to transact business
    1-4  with the state.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 1.03, State Purchasing and General
    1-7  Services Act (Article 601b, Vernon's Texas Civil Statutes), is
    1-8  amended by adding Subsection (q) to read as follows:
    1-9        (q)  The commission shall adopt rules to implement the
   1-10  provisions of this Act that relate to historically underutilized
   1-11  businesses. If the historically underutilized business disparity
   1-12  study prepared by the comptroller under Section 101, Article V,
   1-13  Chapter 1051, Acts of the 73rd Legislature, Regular Session, 1993
   1-14  (the General Appropriations Act), addresses an issue that is
   1-15  covered by the rules, the commission shall base the provisions of
   1-16  the rules that cover that issue on the results of the disparity
   1-17  study.  A state agency:
   1-18              (1)  shall adopt the commission's rules under this
   1-19  section as the agency's own rules; and
   1-20              (2)  may adopt supplemental rules that are based on the
   1-21  historically underutilized business disparity study and consistent
   1-22  with the commission's rules.
   1-23        SECTION 2.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended,
    2-4  and that this Act take effect and be in force from and after its
    2-5  passage, and it is so enacted.
