1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to rulemaking authority under the state's program to
1-11 assist historically underutilized businesses to transact business
1-12 with the state.
1-13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14 SECTION 1. Section 1.03, State Purchasing and General
1-15 Services Act (Article 601b, Vernon's Texas Civil Statutes), is
1-16 amended by adding Subsection (q) to read as follows:
1-17 (q) The commission shall adopt rules to implement the
1-18 provisions of this Act that relate to historically underutilized
1-19 businesses. The commission shall base the rules on the results of
1-20 the disparity study prepared by the comptroller under Section 101,
1-21 Article V, Chapter 1051, Acts of the 73rd Legislature, 1993 (the
1-22 General Appropriations Act). A state agency or an institution of
1-23 higher education:
1-24 (1) shall adopt the commission's rules under this
1-25 section as the agency's or institution's own rules; and
1-26 (2) may adopt supplemental rules that are based on the
1-27 historically underutilized business disparity study and consistent
1-28 with the commission's rules.
1-29 SECTION 2. The importance of this legislation and the
1-30 crowded condition of the calendars in both houses create an
1-31 emergency and an imperative public necessity that the
1-32 constitutional rule requiring bills to be read on three several
1-33 days in each house be suspended, and this rule is hereby suspended,
1-34 and that this Act take effect and be in force from and after its
1-35 passage, and it is so enacted.
