                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to purchases of agricultural products by school districts
    1-3  and institutions of higher education.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter Z, Chapter 21, Education Code, is
    1-6  amended by adding Section 21.940 to read as follows:
    1-7        Sec. 21.940.  PURCHASE OF AGRICULTURAL PRODUCTS.  A school
    1-8  district that purchases agricultural products shall give first
    1-9  preference to products grown in Texas and second preference to
   1-10  products offered by Texas bidders, the cost to the district and
   1-11  quality being equal.
   1-12        SECTION 2.  Subchapter Z, Chapter 51, Education Code, is
   1-13  amended by adding Section 51.940 to read as follows:
   1-14        Sec. 51.940.  PURCHASE OF AGRICULTURAL PRODUCTS.  An
   1-15  institution of higher education, as defined by Section 61.003, that
   1-16  purchases agricultural products shall give first preference to
   1-17  products grown in Texas and second preference to products offered
   1-18  by Texas bidders, the cost to the institution and quality being
   1-19  equal.
   1-20        SECTION 3.  This Act takes effect September 1, 1995.
   1-21        SECTION 4.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
