A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to conditions of employment for certain officers of the
1-3 state or a political subdivision of the state.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 140.004, Local Government Code, is
1-6 amended to read as follows:
1-7 Sec. 140.004. BUDGETS OF CERTAIN JUVENILE BOARDS AND
1-8 COMMUNITY SUPERVISION AND CORRECTIONS <PROBATION> DEPARTMENTS.
1-9 (a) This section applies only to:
1-10 (1) a juvenile board, juvenile probation office, or
1-11 juvenile department established for one or more counties; and
1-12 (2) a community supervision and corrections <an adult
1-13 probation office or> department established for a judicial
1-14 district.
1-15 (b) Before the 45th day before the first day of the fiscal
1-16 year of a county, a juvenile board and a community supervision and
1-17 corrections <probation> department that each have jurisdiction in
1-18 the county shall:
1-19 (1) prepare a budget for the board's or department's
1-20 next fiscal year; and
1-21 (2) hold a meeting to finalize the budget.
1-22 (c) Before the 14th day before the juvenile board or
1-23 community supervision and corrections <probation> department has a
1-24 meeting to finalize its budget, the board or department shall file
2-1 with the commissioners court:
2-2 (1) a copy of the proposed budget; and
2-3 (2) a statement containing the date of the board's or
2-4 department's meeting to finalize its budget.
2-5 (d) Before the later of the 90th day after the last day of
2-6 the juvenile board's or community supervision and corrections
2-7 <probation> department's fiscal year, or the date the county
2-8 auditor's annual report is made to the commissioners court, the
2-9 board or department shall file with the commissioners court a
2-10 complete financial statement of the board or department covering
2-11 the board's or department's preceding fiscal year.
2-12 (e) The financial statement required by Subsection (d) must
2-13 contain any information considered appropriate by the juvenile
2-14 board or community supervision and corrections <probation>
2-15 department and any information required by the commissioners court
2-16 of each county in which the board or department has jurisdiction.
2-17 (f) The budget for a juvenile board or community supervision
2-18 and corrections department may not include an automobile allowance
2-19 for a member of the governing body of the board or department if
2-20 the member holds another state, county, or municipal office. The
2-21 budget may include reimbursement of actual travel expenses,
2-22 including mileage for automobile travel, incurred while the member
2-23 is engaged in the official business of the board or department.
2-24 SECTION 2. Section 157.021, Local Government Code, is
2-25 amended to read as follows:
2-26 Sec. 157.021. Hours of Work of County Employees <in Counties
2-27 of 355,000 or More>. (a) In a county with a population of 355,000
3-1 or more, the commissioners court may adopt and enforce uniform
3-2 rules on the hours of work of department heads, assistants,
3-3 deputies, and other employees whose compensation is set or approved
3-4 by the court.
3-5 (b) The commissioners court of any county may adopt and
3-6 enforce uniform rules on overtime and compensatory time for
3-7 department heads, assistants, deputies, and other employees whose
3-8 compensation is set or approved by the commissioners court. The
3-9 rules may:
3-10 (1) prohibit unbudgeted overtime, except when the
3-11 commissioners court or an elected county or district officer
3-12 declares an emergency; and
3-13 (2) require that emergency overtime be reported to the
3-14 county auditor and the commissioners court.
3-15 SECTION 3. Section 391.011, Local Government Code, is
3-16 amended by adding Subsection (d) to read as follows:
3-17 (d) A commission may not expend funds for an automobile
3-18 allowance for a member of the governing body of the commission if
3-19 the member holds another state, county, or municipal office. Funds
3-20 may be expended for reimbursement of actual travel expenses,
3-21 including mileage for automobile travel, incurred while the member
3-22 is engaged in the official business of the commission.
3-23 SECTION 4. This Act takes effect September 1, 1995.
3-24 SECTION 5. The importance of this legislation and the
3-25 crowded condition of the calendars in both houses create an
3-26 emergency and an imperative public necessity that the
3-27 constitutional rule requiring bills to be read on three several
4-1 days in each house be suspended, and this rule is hereby suspended.
