    1-8                         A BILL TO BE ENTITLED
    1-9                                AN ACT
   1-10  relating to an automobile allowance paid to certain officers of the
   1-11  state or a political subdivision of the state.
   1-12        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-13        SECTION 1.  Section 140.004, Local Government Code, is
   1-14  amended to read as follows:
   1-15        Sec. 140.004.  BUDGETS OF CERTAIN JUVENILE BOARDS AND
   1-16  COMMUNITY SUPERVISION AND CORRECTIONS <PROBATION> DEPARTMENTS.
   1-17  (a)  This section applies only to:
   1-18              (1)  a juvenile board, juvenile probation office, or
   1-19  juvenile department established for one or more counties;  and
   1-20              (2)  a community supervision and corrections <an adult
   1-21  probation office or> department established for a judicial
   1-22  district.
   1-23        (b)  Before the 45th day before the first day of the fiscal
   1-24  year of a county, a juvenile board and a community supervision and
   1-25  corrections <probation> department that each have jurisdiction in
   1-26  the county shall:
   1-27              (1)  prepare a budget for the board's or department's
   1-28  next fiscal year; and
   1-29              (2)  hold a meeting to finalize the budget.
   1-30        (c)  Before the 14th day before the juvenile board or
   1-31  community supervision and corrections <probation> department has a
   1-32  meeting to finalize its budget, the board or department shall file
   1-33  with the commissioners court:
   1-34              (1)  a copy of the proposed budget;  and
   1-35              (2)  a statement containing the date of the board's or
   1-36  department's meeting to finalize its budget.
   1-37        (d)  Before the later of the 90th day after the last day of
   1-38  the juvenile board's or community supervision and corrections
   1-39  <probation> department's fiscal year, or the date the county
   1-40  auditor's annual report is made to the commissioners court, the
   1-41  board or department shall file with the commissioners court a
   1-42  complete financial statement of the board or department covering
   1-43  the board's or department's preceding fiscal year.
   1-44        (e)  The financial statement required by Subsection (d) must
   1-45  contain any information considered appropriate by the juvenile
   1-46  board or community supervision and corrections <probation>
   1-47  department and any information required by the commissioners court
   1-48  of each county in which the board or department has jurisdiction.
   1-49        (f)  The budget for a juvenile board or community supervision
   1-50  and corrections department may not include an automobile allowance
   1-51  for a member of the governing body of the board or department if
   1-52  the member holds another state, county, or municipal office.  The
   1-53  budget may include reimbursement of actual travel expenses,
   1-54  including mileage for automobile travel, incurred while the member
   1-55  is engaged in the official business of the board or department.
   1-56        SECTION 2.  Section 391.011, Local Government Code, is
   1-57  amended by adding Subsection (d) to read as follows:
   1-58        (d)  A commission may not expend funds for an automobile
   1-59  allowance for a member of the governing body of the commission if
   1-60  the member holds another state, county, or municipal office.  Funds
   1-61  may be expended for reimbursement of actual travel expenses,
   1-62  including mileage for automobile travel, incurred while the member
   1-63  is engaged in the official business of the commission.
   1-64        SECTION 3.  This Act takes effect September 1, 1995.
   1-65        SECTION 4.  The importance of this legislation and the
   1-66  crowded condition of the calendars in both houses create an
   1-67  emergency and an imperative public necessity that the
   1-68  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
