1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the election of the members of the board of directors
1-9 of the Jack County Hospital District.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 4.01, Chapter 16, Acts of the 70th
1-12 Legislature, Regular Session, 1987, is amended to read as follows:
1-13 Sec. 4.01. BOARD OF DIRECTORS; ELECTION. (a) The district
1-14 is governed by a board of five directors <appointed by the
1-15 commissioners court of Jack County>. Members of the board of
1-16 directors are elected at large by place.
1-17 (b) Board members serve staggered terms of two years. A
1-18 member's term begins on June 1 following the date the member is
1-19 elected. <However, in making the initial appointments under this
1-20 section, the commissioners court shall designate:>
1-21 <(1) two directors to serve terms that expire in the
1-22 year following the year of appointment on the first day of the
1-23 month of that year corresponding to the month of appointment; and>
1-24 <(2) three directors to serve terms that expire in the
1-25 second year following the year of appointment on the first day of
1-26 the month of that year corresponding to the month of appointment.>
1-27 (c) A directors' election shall be held on the first
1-28 Saturday in May of each year to elect the appropriate number of
1-29 successor directors. <From the time the creation of the district
1-30 is approved until the directors are appointed under this section
1-31 and take office, the temporary directors serve as directors of the
1-32 district.>
1-33 SECTION 2. Section 4.02, Chapter 16, Acts of the 70th
1-34 Legislature, Regular Session, 1987, is amended to read as follows:
1-35 Sec. 4.02. Qualifications for office. To be eligible to be
1-36 a candidate for or to serve <appointed> as a director, a person
1-37 must be:
1-38 (1) a resident of the district; and
1-39 (2) a qualified voter.
1-40 SECTION 3. Section 4.04, Chapter 16, Acts of the 70th
1-41 Legislature, Regular Session, 1987, is amended to read as follows:
1-42 Sec. 4.04. BOARD VACANCY. A vacancy in the office of
1-43 director shall be filled for the unexpired term by appointment by
1-44 the remaining directors <commissioners court of Jack County>.
1-45 SECTION 4. (a) This Act takes effect September 1, 1995.
1-46 The first election of the Jack County Hospital District board of
1-47 directors shall be held May 4, 1996. This section applies to the
1-48 first two elections of directors notwithstanding other law.
1-49 (b) On the effective date of this Act, the board shall
1-50 designate the positions of the directors serving in offices for
1-51 which the terms expire December 31, 1995, as Place 2 and Place 4,
1-52 respectively, and shall designate the positions of the directors
1-53 serving in offices for which the terms expire December 31, 1996, as
1-54 Place 1, Place 3, and Place 5, respectively.
1-55 (c) At the first election for directors under this Act,
1-56 directors shall be elected for Place 1, Place 3, and Place 5 for
1-57 terms expiring June 1, 1998. The terms of office for appointed
1-58 directors serving in those places expire on the date the elected
1-59 directors qualify for office.
1-60 (d) At the second election for directors under this Act,
1-61 directors shall be elected for Place 2 and Place 4 for terms
1-62 expiring June 1, 1999. The terms of office for appointed directors
1-63 serving in those places expire on the date the elected directors
1-64 qualify for office.
1-65 SECTION 5. The importance of this legislation and the
1-66 crowded condition of the calendars in both houses create an
1-67 emergency and an imperative public necessity that the
1-68 constitutional rule requiring bills to be read on three several
2-1 days in each house be suspended, and this rule is hereby suspended.
