                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of the Department of Agriculture to sell
    1-3  advertisements in its publications.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 12, Agriculture Code, is amended by
    1-6  adding Section 12.032 to read as follows:
    1-7        Sec. 12.032.  ADVERTISEMENTS IN DEPARTMENT PUBLICATIONS.  (a)
    1-8  The department may sell advertisements in publications of the
    1-9  department.
   1-10        (b)  The department shall adopt rules to implement the sale
   1-11  of advertisements under Subsection (a), including rules regulating:
   1-12              (1)  the cost of advertisements;
   1-13              (2)  the type of products or services that may be
   1-14  advertised;
   1-15              (3)  the size of advertisements; and
   1-16              (4)  refunds on advertisements that are not run.
   1-17        (c)  Proceeds from the sale of advertisements shall be
   1-18  deposited in the general revenue fund.
   1-19        SECTION 2.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
   1-24  and that this Act take effect and be in force from and after its
    2-1  passage, and it is so enacted.
