No. 590 By: Brown 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to the authority of the Department of Agriculture to sell 1-11 advertisements in its publications. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Chapter 12, Agriculture Code, is amended by 1-14 adding Section 12.032 to read as follows: 1-15 Sec. 12.032. ADVERTISEMENTS IN DEPARTMENT PUBLICATIONS. 1-16 (a) The department may sell advertisements in publications of the 1-17 department. 1-18 (b) The department shall adopt rules to implement the sale 1-19 of advertisements under Subsection (a), including rules regulating: 1-20 (1) the costs of advertisements; 1-21 (2) the type of products, services, or events that may 1-22 be advertised; 1-23 (3) the size of advertisements; and 1-24 (4) refunds on advertisements that are not run. 1-25 (c) Proceeds from the sale of advertisements shall be used 1-26 to pay the department's publication costs. Any excess funds shall 1-27 be deposited in the general revenue fund. 1-28 SECTION 2. The importance of this legislation and the 1-29 crowded condition of the calendars in both houses create an 1-30 emergency and an imperative public necessity that the 1-31 constitutional rule requiring bills to be read on three several 1-32 days in each house be suspended, and this rule is hereby suspended, 1-33 and that this Act take effect and be in force from and after its 1-34 passage, and it is so enacted. 1-35 * * * * *
