                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to certain educational programs under a managed care
    1-3  Medicaid program.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 16, Article 4413(502), Revised Statutes,
    1-6  is amended to read as follows:
    1-7        Sec. 16.  ADMINISTRATION OF MEDICAID PROGRAM.  (a)  On
    1-8  approval by the federal government, the commission is the state
    1-9  agency designated to administer federal medicaid assistance funds.
   1-10        (b)  In adopting rules implementing a state-managed care
   1-11  Medicaid program, the commission shall establish guidelines for and
   1-12  require managed care organizations to provide education programs
   1-13  for providers and patients.  Provider education programs shall
   1-14  include information on administrative procedures for billing and
   1-15  the specific problems and needs of Medicaid clients.  Patient
   1-16  education programs shall include:
   1-17              (1)  information on the patient's right to health care
   1-18  services; and
   1-19              (2)  instruction on the patient's responsibility to
   1-20  manage personal health care, including instruction on making and
   1-21  keeping an appointment with a health care provider and the
   1-22  importance of following drug regimens prescribed by the provider.
   1-23        SECTION 2.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
    2-1  emergency and an imperative public necessity that the
    2-2  constitutional rule requiring bills to be read on three several
    2-3  days in each house be suspended, and this rule is hereby suspended,
    2-4  and that this Act take effect and be in force from and after its
    2-5  passage, and it is so enacted.
