                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the duty of the Texas Department of Mental Health and
    1-2  Mental Retardation to evaluate and revise its sliding fee
    1-3  schedules.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 552.017, Health and Safety Code, is
    1-6  amended by adding Subsection (e) to read as follows:
    1-7        (e)  The department shall evaluate and, if necessary, revise
    1-8  the fee schedule at least once every five years.
    1-9        SECTION 2.  Section 593.075, Health and Safety Code, is
   1-10  amended by adding Subsection (e) to read as follows:
   1-11        (e)  The department shall evaluate and, if necessary, revise
   1-12  the fee schedule at least once every five years.
   1-13        SECTION 3.  Not later than January 1, 1996, the Texas
   1-14  Department of Mental Health and Mental Retardation shall evaluate
   1-15  and, if necessary, revise its sliding fee schedules as required by
   1-16  Subsection (e), Section 552.017, and Subsection (e), Section
   1-17  593.075, Health and Safety Code, as added by this Act.
   1-18        SECTION 4.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended,
   1-23  and that this Act take effect and be in force from and after its
   1-24  passage, and it is so enacted.
