A BILL TO BE ENTITLED
AN ACT
1-1 relating to provisional certification of certain emergency medical
1-2 personnel.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subchapter C, Chapter 773, Health and Safety
1-5 Code, is amended by adding Section 773.0551 to read as follows:
1-6 Sec. 773.0551. PROVISIONAL CERTIFICATE. (a) The department
1-7 may issue a provisional certificate to a person who:
1-8 (1) has not taken the examination for certification;
1-9 (2) is enrolled in an approved certification training
1-10 program; and
1-11 (3) possesses the qualifications for provisional
1-12 certification required by rules adopted by the board.
1-13 (b) A person who holds a provisional certificate may only
1-14 provide emergency medical services permitted under rules adopted by
1-15 the board. The person may only provide emergency medical services
1-16 under the supervision of a program instructor or other person
1-17 designated by board rule.
1-18 (c) A provisional certificate is valid until the earlier of:
1-19 (1) the date on which the holder receives a
1-20 certificate under Section 773.055(e);
1-21 (2) the date on which the holder receives notice of
1-22 failure of the holder's examination for certification; or
1-23 (3) the first date on which the holder is no longer
2-1 enrolled in an approved certification training program and has not
2-2 completed the program.
2-3 (d) The board shall adopt rules providing standards for the
2-4 supervision to be provided by an instructor or other designated
2-5 person for a provisional certificate holder under this section.
2-6 SECTION 2. (a) This Act takes effect September 1, 1995.
2-7 (b) The Texas Board of Health shall adopt rules under this
2-8 Act not later than December 31, 1995.
2-9 SECTION 3. The importance of this legislation and the
2-10 crowded condition of the calendars in both houses create an
2-11 emergency and an imperative public necessity that the
2-12 constitutional rule requiring bills to be read on three several
2-13 days in each house be suspended, and this rule is hereby suspended.
