    1-8                         A BILL TO BE ENTITLED
    1-9                                AN ACT
   1-10  relating to municipal regulation of pool yard enclosures.
   1-11        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-12        SECTION 1.  Subsection (a), Section 214.101, Local Government
   1-13  Code, is amended to read as follows:
   1-14        (a)  A municipality may by ordinance establish minimum
   1-15  standards for swimming pool fences and enclosures and may adopt
   1-16  other ordinances as necessary to carry out this subchapter.  A
   1-17  municipal ordinance containing standards for a pool yard enclosure
   1-18  as defined by Chapter 757, Health and Safety Code, as added by
   1-19  Section 2, Chapter 517, Acts of the 73rd Legislature, 1993, must
   1-20  contain the same standards for that enclosure as are required or
   1-21  permitted by that chapter of the Health and Safety Code.
   1-22        SECTION 2.  This Act takes effect September 1, 1995.
   1-23        SECTION 3.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
   1-25  emergency and an imperative public necessity that the
   1-26  constitutional rule requiring bills to be read on three several
   1-27  days in each house be suspended, and this rule is hereby suspended.
