No. 627 by adding the following as a new SECTION 2 1-9 of the bill and renumbering the existing SECTION 2 of the bill 1-10 appropriately: 1-11 "SECTION 2. (a) The Texas State Library and Archives 1-12 Commission may not use appropriated money but may use gifts or 1-13 grants to restore the San Jacinto battle flags to a suitable 1-14 condition under an agreement to trade or lend the flags that is 1-15 made in accordance with Section 441.0115, Government Code, as added 1-16 by this Act. 1-17 (b) If an agreement to trade or lend the Alamo and San 1-18 Jacinto battle flags that is made in accordance with Section 1-19 441.0115, Government Code, as added by this Act, does not provide 1-20 that Mexico will restore the Alamo battle flag to a suitable 1-21 condition before the trade or loan of the flag, the Texas State 1-22 Library and Archives Commission may not use appropriated money but 1-23 may use gifts or grants to restore the Alamo battle flag to a 1-24 suitable condition after the trade or loan of the flags." 1-25 COMMITTEE AMENDMENT NO. 2 By: Armbrister 1-26 Amend S.B. No. 627, SECTION 1, on page 1, line 20 (committee 1-27 printing page 1, line 50) after the word "flags" by adding "as long 1-28 as such conditioning does not alter the authenticity or integrity 1-29 of the flags" 1-30 A BILL TO BE ENTITLED 1-31 AN ACT 1-32 relating to authorizing the Texas State Library and Archives 1-33 Commission to negotiate an agreement with the appropriate 1-34 authorities in Mexico for the exchange of certain Alamo and San 1-35 Jacinto battle flags. 1-36 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-37 SECTION 1. Subchapter A, Chapter 441, Government Code, is 1-38 amended by adding Section 441.0115 to read as follows: 1-39 Sec. 441.0115. AGREEMENT WITH MEXICO. The commission may 1-40 negotiate an agreement with the appropriate authorities in Mexico 1-41 under which Texas will trade or lend to Mexico the flags of the 1-42 Toluca Battalion, the Guerrero Battalion, and the Matamoros 1-43 Battalion captured at the Battle of San Jacinto and Mexico will 1-44 trade or lend to Texas the flag of the New Orleans Greys captured 1-45 at the Battle of the Alamo. An agreement under this section: 1-46 (1) may not affect title to the flags; 1-47 (2) may provide that Texas will restore the San 1-48 Jacinto flags to a suitable condition and Mexico will restore the 1-49 Alamo flag to a suitable condition before the trade or loan of the 1-50 flags; and 1-51 (3) is not valid if it is not approved by the governor 1-52 and by the appropriate authority for approval under the laws of 1-53 Mexico. 1-54 SECTION 2. The importance of this legislation and the 1-55 crowded condition of the calendars in both houses create an 1-56 emergency and an imperative public necessity that the 1-57 constitutional rule requiring bills to be read on three several 1-58 days in each house be suspended, and this rule is hereby suspended, 1-59 and that this Act take effect and be in force from and after its 1-60 passage, and it is so enacted. 1-61 * * * * *
