                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the construction of certain road projects in certain
    1-3  municipalities and counties.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 1, Title 116, Revised Statutes, is
    1-6  amended by adding Article 6674p-1 to read as follows:
    1-7        Art. 6674p-1.  CONSTRUCTION OF ROAD PROJECTS IN CERTAIN
    1-8  MUNICIPALITIES AND COUNTIES.  (a)  This article applies only to a
    1-9  road project that is:
   1-10              (1)  located in a municipality with a population of
   1-11  200,000 or more or a county with a population of 200,000 or more;
   1-12              (2)  funded by the department with state or federal
   1-13  aid; and
   1-14              (3)  not part of the state highway system.
   1-15        (b)  On the request of the governing body of a municipality
   1-16  or a county, as appropriate, the department shall allow the
   1-17  municipality or the county direct control over the construction of
   1-18  a road project to which this article applies, including the
   1-19  authority to contract for the construction of the project and to
   1-20  specify local design standards for the project.
   1-21        SECTION 2.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
