    1-7  Amend S.B. No. 652 as follows:
    1-8        (1)  On page 1, line 10 (Committee printing page 1, line 22)
    1-9  delete "in the exercise of a water use permit issued under Chapter
   1-10  11, Water Code" and substitute "when such disturbances or takings
   1-11  occur for maintenance projects carried out by public utilities".
   1-12                         A BILL TO BE ENTITLED
   1-13                                AN ACT
   1-14  relating to an exemption from sand and gravel permitting
   1-15  requirements.
   1-16        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-17        SECTION 1.  Chapter 86, Parks and Wildlife Code, is amended
   1-18  by adding Section 86.0191 to read as follows:
   1-19        Sec. 86.0191.  WATER USE PERMIT:  EXEMPTION.  The commission
   1-20  by rule shall exempt from the permit requirements of this chapter a
   1-21  person who disturbs or takes marl, sand, gravel, shell, or mudshell
   1-22  for noncommercial purposes in the exercise of a water use permit
   1-23  issued under Chapter 11, Water Code.
   1-24        SECTION 2.  This Act takes effect September 1, 1995.
   1-25        SECTION 3.  The importance of this legislation and the
   1-26  crowded condition of the calendars in both houses create an
   1-27  emergency and an imperative public necessity that the
   1-28  constitutional rule requiring bills to be read on three several
   1-29  days in each house be suspended, and this rule is hereby suspended.
