                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the accessibility of certain glues and paints to
    1-2  business patrons in certain municipalities.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 485.018(b), Health and Safety Code, is
    1-5  amended to read as follows:
    1-6        (b)  This section does not apply to an ordinance or rule
    1-7  that:
    1-8              (1)  was enacted before September 1, 1989; or
    1-9              (2)  is enacted by a municipality if the governing body
   1-10  of the municipality finds by resolution that the problems
   1-11  associated with glue or aerosol paint abuse in the municipality are
   1-12  so pervasive that enacting an ordinance or rule limiting patron
   1-13  accessibility is necessary to promote public health, safety, or
   1-14  welfare.
   1-15        SECTION 2.  The importance of this legislation and the
   1-16  crowded condition of the calendars in both houses create an
   1-17  emergency and an imperative public necessity that the
   1-18  constitutional rule requiring bills to be read on three several
   1-19  days in each house be suspended, and this rule is hereby suspended,
   1-20  and that this Act take effect and be in force from and after its
   1-21  passage, and it is so enacted.
