                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the practice of chiropractic.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 1, Chapter 94, Acts of the 51st
    1-4  Legislature, Regular Session, 1949 (Article 4512b, Vernon's Texas
    1-5  Civil Statutes), is amended to read as follows:
    1-6        Sec. 1.  (a)  A person shall be regarded as practicing
    1-7  chiropractic within the meaning of this Act if the person:
    1-8              (1)  analyzes, examines, or evaluates <uses objective
    1-9  or subjective means to analyze, examine, or evaluate> the
   1-10  subluxation <biomechanical condition> of the spine or of the <and>
   1-11  musculoskeletal system of the human body as it directly relates to
   1-12  the subluxation of the spine;
   1-13              (2)  performs non-invasive <uses adjustment,
   1-14  manipulation, or other> procedures in order to improve subluxation
   1-15  of the spine or <the biomechanics> of the musculoskeletal system as
   1-16  it directly relates to subluxation of the spine; or
   1-17              (3)  holds himself out to the public as a chiropractor
   1-18  or uses the term "chiropractor," "chiropractic," "doctor of
   1-19  chiropractic," "D.C.," or any derivative of those terms in
   1-20  connection with his name.
   1-21        (b)  The practice of chiropractic shall not be construed to
   1-22  include invasive or surgical procedures, prescribing authority, or
   1-23  any procedures not directly related to subluxation of the spine or
    2-1  of the musculoskeletal system as it directly relates to subluxation
    2-2  of the spine.
    2-3        SECTION 2.  Subsection (a), Section 14c, Chapter 94, Acts of
    2-4  the 51st Legislature, Regular Session, 1949 (Article 4512b,
    2-5  Vernon's Texas Civil Statutes), is amended to read as follows:
    2-6        (a)  The Board shall appoint an enforcement committee to
    2-7  oversee and conduct the investigation of complaints filed with the
    2-8  Board under this Act and to perform other duties related to
    2-9  enforcement as directed by the Board.  The enforcement committee is
   2-10  composed of:
   2-11              (1)  two or more Board members, at least one of whom is
   2-12  a doctor of chiropractic and at least one of whom is a
   2-13  representative of the general public; and
   2-14              (2)  the executive director<; and>
   2-15              <(3)  a representative of the attorney general's
   2-16  office>.
   2-17        SECTION 3.  The importance of this legislation and the
   2-18  crowded condition of the calendars in both houses create an
   2-19  emergency and an imperative public necessity that the
   2-20  constitutional rule requiring bills to be read on three several
   2-21  days in each house be suspended, and this rule is hereby suspended,
   2-22  and that this Act take effect and be in force from and after its
   2-23  passage, and it is so enacted.
