    1-8                         A BILL TO BE ENTITLED
    1-9                                AN ACT
   1-10  relating to appropriations to an institution of higher education
   1-11  for energy costs.
   1-12        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-13        SECTION 1.  Section 51.927, Education Code, is amended by
   1-14  adding Subsection (j) to read as follows:
   1-15        (j)  The legislature shall base an institution's
   1-16  appropriation for energy costs during a fiscal year on the sum of:
   1-17              (1)  the institution's estimated energy costs for that
   1-18  fiscal year; and
   1-19              (2)  if a contract under this section is in effect, the
   1-20  institution's estimated net savings resulting from the contract
   1-21  during the contract term, divided by the number of years in the
   1-22  contract term.
   1-23        SECTION 2.  (a)  This Act takes effect September 1, 1995.
   1-24        (b)  This Act does not apply to an appropriation enacted
   1-25  before the effective date of this Act, without regard to the period
   1-26  for which the appropriation is made.
   1-27        SECTION 3.  The importance of this legislation and the
   1-28  crowded condition of the calendars in both houses create an
   1-29  emergency and an imperative public necessity that the
   1-30  constitutional rule requiring bills to be read on three several
   1-31  days in each house be suspended, and this rule is hereby suspended.
