                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the allowable size of a business under the state's
    1-3  program to assist historically underutilized businesses to transact
    1-4  business with the state.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 1.03, State Purchasing and General
    1-7  Services Act (Article 601b, Vernon's Texas Civil Statutes), is
    1-8  amended by adding Subsection (q) to read as follows:
    1-9        (q)  The commission may not certify a business as a
   1-10  historically underutilized business and shall revoke a business's
   1-11  certification as a historically underutilized business if, during
   1-12  each of the three preceding calendar years, the business has
   1-13  exceeded the size standard set by the federal Small Business
   1-14  Administration under 13 C.F.R. Section 121.601 for a business with
   1-15  the applicable four-digit Standard Industrial Classification code.
   1-16        SECTION 2.  The importance of this legislation and the
   1-17  crowded condition of the calendars in both houses create an
   1-18  emergency and an imperative public necessity that the
   1-19  constitutional rule requiring bills to be read on three several
   1-20  days in each house be suspended, and this rule is hereby suspended,
   1-21  and that this Act take effect and be in force from and after its
   1-22  passage, and it is so enacted.
