                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to curbing the incidence of graffiti; providing a penalty.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 485.018, Health and Safety Code, is
    1-4  repealed.
    1-5        SECTION 2.  Section 485.031, Health and Safety Code, is
    1-6  amended by amending Subsection (b) and adding Subsections (c) and
    1-7  (d) to read as follows:
    1-8        (b)  An offense under Subsection (a) <this section> is a
    1-9  Class B misdemeanor.
   1-10        (c)  A person who is younger than 18 years of age commits an
   1-11  offense if the person is found to be in possession of aerosol
   1-12  paint.
   1-13        (d)  An offense under Subsection (c) is a Class C misdemeanor
   1-14  punishable by a fine not to exceed $500.
   1-15        SECTION 3.  This Act takes effect September 1, 1995.
   1-16        SECTION 4.  The importance of this legislation and the
   1-17  crowded condition of the calendars in both houses create an
   1-18  emergency and an imperative public necessity that the
   1-19  constitutional rule requiring bills to be read on three several
   1-20  days in each house be suspended, and this rule is hereby suspended,
   1-21  and that this Act take effect and be in force from and after its
   1-22  passage, and it is so enacted.
