A BILL TO BE ENTITLED
AN ACT
1-1 relating to the fees a county treasurer may charge for returned and
1-2 stopped checks.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 118.141, Local Government Code, is
1-5 amended to read as follows:
1-6 Sec. 118.141. Fee Schedule. (a) The county treasurer, or
1-7 another officer who receives revenue in place of the county
1-8 treasurer, may collect the following fees for services rendered to
1-9 any person:
1-10 (1) Returned check (Sec. 118.142) ........... not less
1-11 than $15.00 or more than $30.00 <$25.00>
1-12 (2) <Stop-payment order (Sec. 118.143) ........ $15.00>
1-13 <(3)> Copy of check or other record (Sec. 118.144)
1-14 ............................................................. $1.00
1-15 (b) The county treasurer or another officer who receives
1-16 revenue in place of the county treasurer may collect, from a person
1-17 to whom the county issues a check, a fee for a stop-payment order
1-18 as described by Section 118.143:
1-19 (1) in an amount equal to the stop-payment fee charged
1-20 to the county by the county depositary bank; or
1-21 (2) in an amount not to exceed $20.00.
1-22 SECTION 2. This Act takes effect September 1, 1995.
1-23 SECTION 3. The importance of this legislation and the
1-24 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended.
