No. 832, SECTION 1, Sec. 5q., Subsection (k), (page 3, 1-8 line 13, introduced version; page 2, line 8, committee printing) as 1-9 follows: between "in" and "entirety" by striking "their" and 1-10 inserting "its" in lieu thereof. 1-11 A BILL TO BE ENTITLED 1-12 AN ACT 1-13 providing for the issuance of specially designed Texas license 1-14 plates for the United States Olympic Committee. 1-15 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-16 SECTION 1. Chapter 88, General Laws, Acts of the 41st 1-17 Legislature, 2nd Called Session, 1929 (Article 6675a-1 et seq., 1-18 Vernon's Texas Civil Statutes), is amended by adding Section 5q to 1-19 read as follows: 1-20 Sec. 5q. (a) The department shall provide for the issuance 1-21 of special United States Olympic Committee plates for passenger 1-22 cars and light commercial motor vehicles having a manufacturer's 1-23 rated carrying capacity of one ton or less. 1-24 (b) The license plates must bear the words "United States 1-25 Olympic Committee" and be of a color, quality, and design approved 1-26 by the United States Olympic Committee. 1-27 (c) The department shall issue plates under this section to 1-28 a person who: 1-29 (1) applies to the county tax collector in the county 1-30 of the person's residence on a form provided by the department; and 1-31 (2) pays the fee prescribed by Subsection (e) of this 1-32 section. 1-33 (d) A person applying for license plates under this section 1-34 may: 1-35 (1) have a license plate number assigned by the 1-36 department; or 1-37 (2) apply for personalized prestige license plates 1-38 under this Act. 1-39 (e) The fee for issuance of special license plates under 1-40 this section is $50 for each year in which the vehicle is 1-41 registered in addition to the regular registration fee for the 1-42 vehicle imposed by Section 5 of this Act and, if personalized 1-43 prestige license plates are issued, in addition to the fee imposed 1-44 by this Act. 1-45 (f) There is created in the state's general revenues a 1-46 special nonlapsing fund to be known as the U.S. Olympics trust 1-47 fund--Texas. Money deposited in the fund shall be dedicated to the 1-48 purposes set forth in Subsection (k) of this section. Money held 1-49 in this account shall be held in interest-bearing accounts in 1-50 public depositories authorized by law and may be invested and 1-51 reinvested in such securities as are approved by the state. 1-52 Interest earned or other money from appropriated state funds or any 1-53 other source deposited into the U.S. Olympics trust fund--Texas 1-54 becomes a part of the trust fund and available for use as 1-55 prescribed for the fund. 1-56 (g) The department shall deposit $45 of each fee collected 1-57 under this section in the state treasury to the credit of an 1-58 account in the U.S. Olympics trust fund--Texas. 1-59 (h) The department shall deposit the remainder of each fee 1-60 collected under this section after deposit as provided by 1-61 Subsection (g) of this section in the state treasury to the credit 1-62 of the state highway fund to be used only to defray the cost of 1-63 administering this section. 1-64 (i) If license plates issued under this section are lost, 1-65 stolen, or mutilated, the owner of the vehicle for which the plates 1-66 were issued may obtain replacement plates from the department by 1-67 paying a replacement fee of $5. If the owner of a vehicle for 1-68 which plates were issued under this section disposes of the vehicle 2-1 during a registration year, the person shall return the special 2-2 license plates to the department. 2-3 (j) There is no limit to the number of passenger cars and 2-4 light commercial motor vehicles for which the person may apply for 2-5 issuance of license plates under this section. 2-6 (k) Money deposited in the U.S. Olympics trust fund--Texas 2-7 shall be allocated in their entirety to the United States Olympic 2-8 Committee established and authorized under the Amateur Sports Act 2-9 of 1978 (Pub. L. 95-606) (36 U.S.C. Section 371 et seq.), to be 2-10 used by the United States Olympic Committee, 50 percent for the 2-11 training and development of Texas Olympians and Olympic hopeful 2-12 athletes, as identified by the United States Olympic Committee, and 2-13 50 percent for the training and development of other United States 2-14 amateur athletes and Olympians identified by the United States 2-15 Olympic Committee. The funds in the U.S. Olympics trust 2-16 fund--Texas shall be transferred from the U.S. Olympics trust 2-17 fund--Texas to the United States Olympic Committee no more than one 2-18 time per calendar year as determined by the department. 2-19 SECTION 2. The importance of this legislation and the 2-20 crowded condition of the calendars in both houses create an 2-21 emergency and an imperative public necessity that the 2-22 constitutional rule requiring bills to be read on three several 2-23 days in each house be suspended, and this rule is hereby suspended. 2-24 * * * * *
