                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to tuition and fees at a public institution of higher
    1-3  education for a nonresident student holding a competitive athletic
    1-4  scholarship.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 54.064(a), Education Code, is amended to
    1-7  read as follows:
    1-8        (a)  A student who holds a competitive academic or athletic
    1-9  scholarship of at least $200 for the academic year or summer for
   1-10  which the student is enrolled and who is either a nonresident or a
   1-11  citizen of a country other than the United States of America is
   1-12  entitled to pay the fees and charges required of Texas residents
   1-13  without regard to the length of time the student has resided in
   1-14  Texas. The student must compete with other students, including
   1-15  Texas residents, for the academic or athletic scholarship and the
   1-16  scholarship must be awarded by a scholarship committee officially
   1-17  recognized by the administration and be approved by the Texas
   1-18  Higher Education Coordinating Board under criteria developed by the
   1-19  board.
   1-20        SECTION 2.  The change in law made by this Act applies
   1-21  beginning with fees and charges due for the fall semester of 1995.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended,
    2-3  and that this Act take effect and be in force from and after its
    2-4  passage, and it is so enacted.
