                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the sale of certain park land by certain
    1-2  municipalities.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 253.001, Local Government Code, is
    1-5  amended by amending Subsection (e) and by adding Subsection (g) to
    1-6  read as follows:
    1-7        (e)  Subsection (b) does not apply to a conveyance of park
    1-8  land that:
    1-9              (1)  is owned by a home-rule municipality with a
   1-10  population of less than 80,000 and that is located in a county
   1-11  bordering the Gulf of Mexico <115,000>;
   1-12              (2)  is one acre or less;
   1-13              (3)  is part of a park that is 100 <600> acres or less;
   1-14              (4)  is sold or is conveyed as a sale to the owner of
   1-15  <part of an exchange for property> adjoining property <the park>;
   1-16  and
   1-17              (5)  is conveyed pursuant to a resolution or an
   1-18  ordinance that:
   1-19                    (A)  is adopted under this section;
   1-20                    (B)  requires the sale to be with an owner of
   1-21  adjoining property for fair market value as determined by an
   1-22  independent appraisal obtained by the municipality; and
   1-23                    (C)  has an effective date before December 31,
   1-24  1995 <November 1, 1989>.
    2-1        (g)  A sale made under Subsection (e) is exempt from the
    2-2  notice and bidding requirements in Chapter 272.
    2-3        SECTION 2.  The importance of this legislation and the
    2-4  crowded condition of the calendars in both houses create an
    2-5  emergency and an imperative public necessity that the
    2-6  constitutional rule requiring bills to be read on three several
    2-7  days in each house be suspended, and this rule is hereby suspended,
    2-8  and that this Act take effect and be in force from and after its
    2-9  passage, and it is so enacted.
