                                        AN ACT
    1-1  relating to the conveyance of a Texas Turnpike Authority project.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Subsections (a) and (b), Section 12c, Chapter
    1-4  410, Acts of the 53rd Legislature, Regular Session, 1953 (Article
    1-5  6674v, Vernon's Texas Civil Statutes), are amended to read as
    1-6  follows:
    1-7        (a)  This section applies only to:
    1-8              (1)  a county, or a local government corporation
    1-9  serving a county, or an adjacent county in a joint turnpike
   1-10  authority with a county whose population is more than 1.5 million<,
   1-11  according to the most recent federal decennial census,> as to which
   1-12  the Authority, the Texas Transportation Commission, and the
   1-13  governor approve the transfer of a Turnpike Project as being in the
   1-14  best interests of the state and the county; and
   1-15              (2)  a municipality with a population of more than
   1-16  120,000 that is adjacent to the United Mexican States if the
   1-17  Authority, the Texas Transportation Commission, and the governor
   1-18  approve the transfer of a Turnpike Project as being in the best
   1-19  interests of the state and the municipality.
   1-20        (b)  The Authority may lease, sell, or otherwise convey a
   1-21  Turnpike Project to a county, <or a> local government corporation
   1-22  created under the Texas Transportation Corporation Act (Article
   1-23  1528l, Vernon's Texas Civil Statutes), or municipality.  A county,
    2-1  <or a> local government corporation, or municipality may lease,
    2-2  buy, or otherwise receive a Turnpike Project.
    2-3        SECTION 2.  Section 12d, Chapter 410, Acts of the 53rd
    2-4  Legislature, Regular Session, 1953 (Article 6674v, Vernon's Texas
    2-5  Civil Statutes), is amended to read as follows:
    2-6        Sec. 12d.  SUCCESSOR AGENCY TO AUTHORITY.  The following are
    2-7  considered successor agencies to the Texas Turnpike Authority for
    2-8  purposes of Article III, Section 52-b, of the Texas Constitution:
    2-9              (1)  a county, <or> local government corporation, or
   2-10  municipality that leases, buys, or receives a Turnpike Project
   2-11  under Section 12c of this Act; and
   2-12              (2)  a county, <or> a local government corporation
   2-13  serving a county, or an adjacent county in a joint turnpike
   2-14  authority with a county whose population is more than 1.5 million<,
   2-15  according to the most recent federal decennial census,> that
   2-16  constructs a toll road, toll bridge, or Turnpike Project.
   2-17        SECTION 3.  The importance of this legislation and the
   2-18  crowded condition of the calendars in both houses create an
   2-19  emergency and an imperative public necessity that the
   2-20  constitutional rule requiring bills to be read on three several
   2-21  days in each house be suspended, and this rule is hereby suspended,
   2-22  and that this Act take effect and be in force from and after its
   2-23  passage, and it is so enacted.
