                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the conveyance of a Texas Turnpike Authority project.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Subsections (a) and (b), Section 12c, Chapter
    1-4  410, Acts of the 53rd Legislature, Regular Session, 1953 (Article
    1-5  6674v, Vernon's Texas Civil Statutes), are amended to read as
    1-6  follows:
    1-7        (a)  This section applies to a county, or a local government
    1-8  corporation serving a county, or an adjacent county in a joint
    1-9  turnpike authority with a county whose population is more than 1.5
   1-10  million, according to the most recent federal decennial census, or
   1-11  a municipality in a county whose population is more than 100,000
   1-12  and less than 200,000 and which borders the Republic of Mexico as
   1-13  to which the Authority, the Texas Transportation Commission, and
   1-14  the governor approve the transfer of a Turnpike Project as being in
   1-15  the best interests of:  (1) the state; and (2) the county or, if
   1-16  the project is conveyed to a municipality, that municipality.
   1-17        (b)  The Authority may lease, sell, or otherwise convey a
   1-18  Turnpike Project to a county, municipality, or a local government
   1-19  corporation created under the Texas Transportation Corporation Act
   1-20  (Article 1528l, Vernon's Texas Civil Statutes).  A county,
   1-21  municipality, or a local government corporation may lease, buy, or
   1-22  otherwise receive a Turnpike Project.
   1-23        SECTION 2.  Section 12d, Chapter 410, Acts of the 53rd
    2-1  Legislature, Regular Session, 1953 (Article 6674v, Vernon's Texas
    2-2  Civil Statutes), is amended to read as follows:
    2-3        Sec. 12d.  The following are considered successor agencies to
    2-4  the Texas Turnpike Authority for purposes of Article III, Section
    2-5  52-b, of the Texas Constitution:
    2-6              (1)  a county, municipality, or local government
    2-7  corporation that leases, buys, or receives a Turnpike Project under
    2-8  Section 12c of this Act; and
    2-9              (2)  a county, or a local government corporation
   2-10  serving a county, or an adjacent county in a joint turnpike
   2-11  authority with a county whose population is more than 1.5 million,
   2-12  according to the most recent federal decennial census, that
   2-13  constructs a toll road, toll bridge, or Turnpike Project.
   2-14        SECTION 3.  The importance of this legislation and the
   2-15  crowded condition of the calendars in both houses create an
   2-16  emergency and an imperative public necessity that the
   2-17  constitutional rule requiring bills to be read on three several
   2-18  days in each house be suspended, and this rule is hereby suspended,
   2-19  and that this Act take effect and be in force from and after its
   2-20  passage, and it is so enacted.
