    1-8                         A BILL TO BE ENTITLED
    1-9                                AN ACT
   1-10  relating to the conveyance of a Texas Turnpike Authority project.
   1-11        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-12        SECTION 1.  Subsections (a) and (b), Section 12c, Chapter
   1-13  410, Acts of the 53rd Legislature, Regular Session, 1953 (Article
   1-14  6674v, Vernon's Texas Civil Statutes), are amended to read as
   1-15  follows:
   1-16        (a)  This section applies only to:
   1-17              (1)  a county, or a local government corporation
   1-18  serving a county, or an adjacent county in a joint turnpike
   1-19  authority with a county whose population is more than 1.5 million<,
   1-20  according to the most recent federal decennial census,> as to which
   1-21  the Authority, the Texas Transportation Commission, and the
   1-22  governor approve the transfer of a Turnpike Project as being in the
   1-23  best interests of the state and the county; and
   1-24              (2)  a municipality with a population of more than
   1-25  120,000 that is adjacent to the United Mexican States if the
   1-26  Authority, the Texas Transportation Commission, and the governor
   1-27  approve the transfer of a Turnpike Project as being in the best
   1-28  interests of the state and the municipality.
   1-29        (b)  The Authority may lease, sell, or otherwise convey a
   1-30  Turnpike Project to a county, <or a> local government corporation
   1-31  created under the Texas Transportation Corporation Act (Article
   1-32  1528l, Vernon's Texas Civil Statutes), or municipality. A county,
   1-33  <or a> local government corporation, or municipality may lease,
   1-34  buy, or otherwise receive a Turnpike Project.
   1-35        SECTION 2.  Section 12d, Chapter 410, Acts of the 53rd
   1-36  Legislature, Regular Session, 1953 (Article 6674v, Vernon's Texas
   1-37  Civil Statutes), is amended to read as follows:
   1-38        Sec. 12d.  SUCCESSOR AGENCY TO AUTHORITY.  The following are
   1-39  considered successor agencies to the Texas Turnpike Authority for
   1-40  purposes of Article III, Section 52-b, of the Texas Constitution:
   1-41              (1)  a county, <or> local government corporation, or
   1-42  municipality that leases, buys, or receives a Turnpike Project
   1-43  under Section 12c of this Act; and
   1-44              (2)  a county, <or> a local government corporation
   1-45  serving a county, or an adjacent county in a joint turnpike
   1-46  authority with a county whose population is more than 1.5 million<,
   1-47  according to the most recent federal decennial census,> that
   1-48  constructs a toll road, toll bridge, or Turnpike Project.
   1-49        SECTION 3.  The importance of this legislation and the
   1-50  crowded condition of the calendars in both houses create an
   1-51  emergency and an imperative public necessity that the
   1-52  constitutional rule requiring bills to be read on three several
   1-53  days in each house be suspended, and this rule is hereby suspended,
   1-54  and that this Act take effect and be in force from and after its
   1-55  passage, and it is so enacted.
