A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to pension benefits for certain peace officers in certain
1-3 municipalities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 11(a), Chapter 76, Acts of the 50th
1-6 Legislature, Regular Session, 1947 (Article 6243g-1, Vernon's Texas
1-7 Civil Statutes), is amended to read as follows:
1-8 (a) A <person who becomes a> member of the Pension System,
1-9 other than a member as defined under Section 1, Article 6243g-3,
1-10 Revised Statutes, <on or after September 1, 1975, and> who has been
1-11 in the service of the city police department for <the period of>
1-12 twenty (20) years <may retire on or after July 1, 1993, and> shall
1-13 be entitled to a retirement pension of an amount equal to two and
1-14 one-fourth percent (2.25%) of his base salary per month for the
1-15 first twenty (20) years of service, plus an additional amount equal
1-16 to two percent (2%) of his base salary per month for each year of
1-17 service in the police department in excess of twenty (20) years,
1-18 not to exceed a total pension equal to eighty percent (80%) of base
1-19 salary, such base salary to be the base salary provided for the
1-20 classified position in the police department held by the member,
1-21 provided that if the member has not held the same classified
1-22 position for three (3) years prior to the date of retirement, the
1-23 retirement pension shall be based on the average monthly base
1-24 salary of the member for three (3) years preceding retirement.
2-1 SECTION 2. Section 11(c), Chapter 76, Acts of the 50th
2-2 Legislature, Regular Session, 1947 (Article 6243g-1, Vernon's Texas
2-3 Civil Statutes), is repealed.
2-4 SECTION 3. Section 11(a), Chapter 76, Acts of the 50th
2-5 Legislature, Regular Session, 1947 (Article 6243g-1, Vernon's Texas
2-6 Civil Statutes), as amended by this Act, applies only to payments
2-7 of pension benefits that become due on or after the effective date
2-8 of this Act.
2-9 SECTION 4. This Act takes effect September 1, 1995.
2-10 SECTION 5. The importance of this legislation and the
2-11 crowded condition of the calendars in both houses create an
2-12 emergency and an imperative public necessity that the
2-13 constitutional rule requiring bills to be read on three several
2-14 days in each house be suspended, and this rule is hereby suspended.
