1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to pension benefits for certain peace officers in certain
1-11 municipalities.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subsection (a), Section 11, Chapter 76, Acts of
1-14 the 50th Legislature, 1947 (Article 6243g-1, Vernon's Texas Civil
1-15 Statutes), is amended to read as follows:
1-16 (a) A <person who becomes a> member of the Pension System,
1-17 including a member as defined under Section 1, Article 6243g-3,
1-18 Revised Statutes, <on or after September 1, 1975, and> who has been
1-19 in the service of the city police department for <the period of>
1-20 twenty (20) years <may retire on or after July 1, 1993, and> shall
1-21 be entitled to a retirement pension of an amount equal to two and
1-22 one-fourth percent (2.25%) of his base salary per month for the
1-23 first twenty (20) years of service, plus an additional amount equal
1-24 to two percent (2%) of his base salary per month for each year of
1-25 service in the police department in excess of twenty (20) years,
1-26 not to exceed a total pension equal to eighty percent (80%) of base
1-27 salary, such base salary to be the base salary provided for the
1-28 classified position in the police department held by the member,
1-29 provided that if the member has not held the same classified
1-30 position for three (3) years prior to the date of retirement, the
1-31 retirement pension shall be based on the average monthly base
1-32 salary of the member for three (3) years preceding retirement.
1-33 SECTION 2. Subsection (c), Section 11, Chapter 76, Acts of
1-34 the 50th Legislature, 1947 (Article 6243g-1, Vernon's Texas Civil
1-35 Statutes), is repealed.
1-36 SECTION 3. Subsection (a), Section 11, Chapter 76, Acts of
1-37 the 50th Legislature, 1947 (Article 6243g-1, Vernon's Texas Civil
1-38 Statutes), as amended by this Act, applies only to payments of
1-39 pension benefits that become due on or after the effective date of
1-40 this Act.
1-41 SECTION 4. This Act takes effect September 1, 1995.
1-42 SECTION 5. The importance of this legislation and the
1-43 crowded condition of the calendars in both houses create an
1-44 emergency and an imperative public necessity that the
1-45 constitutional rule requiring bills to be read on three several
1-46 days in each house be suspended, and this rule is hereby suspended.
