                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to requiring financial assurance from certain persons who
    1-3  use or store electroplating bath solutions.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Subchapter B, Chapter 361, Health and Safety
    1-6  Code, is amended by adding Section 361.040 to read as follows:
    1-7        Sec. 361.040.  FINANCIAL ASSURANCE REQUIRED FOR USERS OF
    1-8  ELECTROPLATING BATH SOLUTION.  (a)  The commission by rule shall
    1-9  require a person to provide to the commission a bond or other
   1-10  financial assurance if the person, in the regular course of
   1-11  business, uses or stores in inventory on the property on which the
   1-12  business is conducted an electroplating bath solution.  The bond or
   1-13  other financial assurance must be in the form and amount prescribed
   1-14  by commission rule and conditioned on the person's satisfactorily
   1-15  operating and closing the business that uses the electroplating
   1-16  bath solution.
   1-17        (b)  The commission shall set the amount of the bond or
   1-18  financial assurance according  to the total volume of
   1-19  electroplating bath solution used or stored on the property and in
   1-20  proportion to the degree and duration of risk associated with the
   1-21  use or storage of that solution.
   1-22        SECTION 2.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended,
    2-3  and that this Act take effect and be in force from and after its
    2-4  passage, and it is so enacted.
