                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the disapproval of a subdivision by a municipality.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Subsection (a), Section 212.009, Local Government
    1-4  Code, is amended to read as follows:
    1-5        (a)  The municipal authority responsible for approving plats
    1-6  shall act on a plat within 60 <30> days after the date the plat is
    1-7  filed.  A plat is considered approved by the municipal authority
    1-8  unless it is disapproved within that period under the provisions of
    1-9  Section 212.005 and a complete list of unmet regulations is
   1-10  provided to the applicant as soon as practicable.
   1-11        SECTION 2.  The change in law made by this Act applies only
   1-12  to a plat for a subdivision filed with a municipality on or after
   1-13  the effective date of this Act.  A plat filed with a municipality
   1-14  before the effective date of this Act is governed by the law in
   1-15  effect when the plat was filed, and the former law is continued in
   1-16  effect for that purpose.
   1-17        SECTION 3.  This Act takes effect September 1, 1995.
   1-18        SECTION 4.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended.
   1-23                       COMMITTEE AMENDMENT NO. 1
   1-24        Amend SB 992 as follows:
    2-1        On line 10, page 1, after the word "practicable", insert the
    2-2  following words between "practicable" and the ".":
    2-3        "but in no event later than 60 days after the date the plat
    2-4  is filed, unless the proposed plat covers an area greater than 540
    2-5  acres"
